ARDEN HILLS CITY COUNCIL—JANUARY 13, 2014 13 <br /> 1. The project shall be completed in accordance with the plans submitted as amended by the <br /> conditions of approval. Any significant changes to these plans, as determined by the City <br /> Planner, shall require review and approval by the Planning Commission and City Council. <br /> 2. A PUD Amendment drafted by the City Attorney shall be executed prior to the issuance of <br /> a building permit. <br /> 3. The applicant shall acquire a Grading and Erosion Control Permit prior to commencing <br /> land disturbing activities on the site. <br /> 4. The Master PUD Amendment and Site Plan Review shall automatically expire and <br /> become void one (1) year after the date on which the Council granted such approval if <br /> work on the project has not begun. <br /> 5. If noise from Building 14 exceeds MPCA noise regulations for residential areas at the <br /> property line, the applicant shall reduce noise levels in order to be in compliance with <br /> MPCA regulations. If the City receives complaints regarding noise levels, the applicant <br /> shall be responsible for providing decibel measurements from the property line and <br /> reducing noise levels to be in compliance with MPCA regulations. <br /> Mayor Grant thanked Associate Planner Bachler for his presentation and asked for Council <br /> comments and questions. <br /> Councilmember Holden asked what would happen if the noise levels were not below the <br /> recommended MPCA standards. <br /> Associate Planner Bachler explained that condition 5 was included to address this concern. The <br /> condition states that if noise from Building 14 exceeds MPCA noise regulations for residential <br /> areas at the property line, the applicant shall reduce noise levels in order to be in compliance with <br /> MPCA regulations. If the City receives complaints regarding noise levels, the applicant shall be <br /> responsible for providing decibel measurements from the property line and reducing noise levels <br /> to be in compliance with MPCA regulations. <br /> Councilmember Holden questioned if additional spruce trees could be added. She commented <br /> that this may benefit the two adjacent residential homes. <br /> Associate Planner Bachler stated that the two spruce trees were required due to the building <br /> space that was being added to the property, and not because of the noise or screening issues. It <br /> was staff's opinion that the existing line of trees provided adequate screening. <br /> Councilmember Holden was in favor of requiring the applicant to plant additional spruce trees <br /> on the property line. She asked if Boston Scientific had any temporary use permits in place. <br /> Associate Planner Bachler reported that Boston Scientific had a temporary use permit for the <br /> walkway that connects Building 3 and Building 10. He stated that the applicant has filed for an <br /> extension of this temporary use permit. <br /> Councilmember Holmes asked for further clarification as to where the noise from this property <br /> will be coming from. <br />
