Recitals. <br /> <br /> A. Inland Shannon Square Shoppes, L.L.C., is a Delaware limited liability company <br />(“Inland”) which is located in the City of Arden Hills, Ramsey County, Minnesota. <br /> <br /> B. On the 6th day of April, 2015, Caribou Coffee Company, Inc., a Minnesota <br />corporation (“Caribou”), and Inland submitted a completed application to the City of Arden Hills <br />(“City”) requesting that its existing Planned Unit Development Agreement be amended to allow the <br />construction and addition of a drive-thru lane and pick-up window on the east side of the retail <br />center, specifically the existing Caribou Coffee located at 3673 Lexington Avenue North, in the <br />City of Arden Hills, Minnesota, which will require modifications to the façade to accommodate the <br />36 square foot addition. In addition, the application also includes related alterations and <br />reconfiguration of the parking area, sidewalk and landscaping, as well as the installation of a menu <br />board, speaker and canvas awning. Said plans and specifications of this project are attached hereto <br />as Exhibit “A”. <br /> <br /> C. At a public hearing on the 6th day of May, 2015, the Arden Hills Planning <br />Commission reviewed Caribou’s application for a Planned Unit Development (PUD) Amendment, <br />the report and recommendations of the Arden Hills City Planner, the comments made at the public <br />hearing, and recommended approval of the PUD Amendment, subject to certain conditions, to the <br />City Council. <br /> <br /> D. On the 26th day of May, 2015, the Arden Hills City Council considered the <br />recommendations of the Planning Commission, the effects of the proposed PUD Amendment on the <br />health, safety, convenience, and general welfare of the owners and occupants of the surrounding
