That the applicant shall continue to abide by all previous agreements, as <br />amended by the conditions of approval of this application. <br />3. That a Planned Unit Development (PUD) Amendment Agreement shall be <br />prepared by the City Attorney and subject to City Council approval. The <br />PUD Amendment Agreement shall be signed by the applicant and <br />approved by Council prior to the issuance of a Final Certificate of <br />Occupancy for Building 1. <br />4. That the approved Landscaping Plan (L3) shall be amended to include <br />three (3) spruce trees in the northwest corner of Building 1. The change to <br />L3 shall be completed as depicted on the Landscape Screening Graphics <br />1A and 1D. <br />5. That the approved Landscaping Plan (L3) shall be amended to include <br />eight (8) lilac trees along the western property line. The change to L3 <br />shall be completed as depicted on the Landscape Screening Graphics 1C <br />and 1E. <br />6. That the approved Landscaping Plan (L3) shall be amended to include <br />climbing ivy in the northwest corner of Building 1. The change to L3 <br />shall be completed as depicted on the Landscape Screening Graphics 1A <br />and 1D. The ivy when established shall significantly cover the panel <br />section where the window omission occurred. <br />7. That the approved Landscaping Plan (L3) shall be amended to relocate <br />three (3) shrubs in the northwest corner of Building 1. The change to L3 <br />shall be completed as depicted on the Landscape Screening Graphics 1A <br />and 1D. <br />8. That the approved Landscaping Plan (L3) shall be amended to remove the <br />one (1) Swamp White Oak and the one (1) Princeton Elm as shown on the <br />Landscaping Screen Graphic 1A located in the northwest corner of <br />Building 1. <br />9. That the Swamp White Oak to be removed shall be replaced with a <br />different tree species with a shallow root structure or with shrubs that will <br />not interfere with the utilities below grade. <br />10. That the approved west elevation on the Exterior Elevation Plan (A3.1) for <br />Building 1 shall be amended in order to omit the section of windows and <br />façade enhancement around the window opening area. The change to <br />A3.1 shall be completed as depicted on the updated A3.1 dated 6/1/15 <br />(Color Option Final) as submitted. <br />11. That the gas lines located in the northwest corner of Building 1 shall be <br />painted to match the adjacent panel color. <br /> <br /> <br />Proposed Motion Language <br /> <br />1.
