Page 1 of 1 <br /> <br />DATE: October 31, 2016 <br /> <br />TO: Honorable Mayor and City Councilmembers <br />Sue Iverson, Interim City Administrator <br /> <br />FROM: Andy Brotzler, Interim Public Works Director/City Engineer <br /> <br />SUBJECT: Approve Assessment Agreement with Boston Scientific <br /> <br /> <br />Requested Action <br /> <br />Authorize the Mayor and Interim City Administrator to execute the Assessment Agreement with <br />Boston Scientific for a fire hydrant relocation and associated water main work. <br /> <br />Background <br /> <br />Staff informed the City Council of concerns with construction associated with the City’s 16” <br />water main at the Boston Scientific site as outlined in Attachment A. The purpose of this item is <br />to approve an assessment agreement with Boston Scientific to ensure that the City is reimbursed <br />for the cost of the work that is outlined the attached proposal from Valley Rich Co., Inc. <br />(Attachment B). <br /> <br />The City Attorney has prepared the attached Assessment Agreement which has been executed by <br />Boston Scientific’s facility manager. The agreement provides the opportunity for the City to <br />assess the Boston Scientific property in the event that they choose not to pay the City in full upon <br />completion of the work and waives their right to appeal the assessment in accordance with MN <br />Statute Chapter 429. <br /> <br />Attachments: <br /> <br />A – Memo dated October 21, 2016 from Interim Assistant Public Works Director <br />B – Proposal from Valley-Rich Co., Inc. for Hydrant Replacement <br />C – Assessment Agreement <br /> STAFF COMMENTS – 9B <br /> <br /> MEMORANDUM <br />
