The applicant shall submit a circulation plan that demonstrates that the use will not <br />interfere or reduce the safety of non-motorized movements, specifically pedestrian and <br />bicyclists. <br /> <br />The Lexington Station project is considered to be an architecturally unified complex as defined <br />in Section 1320.09, Subd. 3 of the Zoning Code. All businesses using drive up-windows on the <br />site would use shared access drives and parking. Staff believes the location of the drive-up lane <br />on the rear side of the Phase 2 building will help reduce conflicts with other vehicular traffic, <br />pedestrians, and bicyclists. The final design of the drive-up lane and window for the Phase 3 <br />building will be evaluated at the time of Final PUD submittal for Phase 3. <br /> <br />Section 1325 – General Regulations <br /> <br />A. Accessory Structures – Section 1325.01 – Meets Requirements <br /> <br />In all zoning districts, an accessory structure cannot exceed the height of the principal structure <br />on the property. The trash enclosure that will service the Phase 2 building has a height of <br />approximately 14 feet, less that the height of the principal building. <br /> <br />B. Additional Requirements for Drive-up Windows – Section 1325.04 – Flexibility Requested <br /> <br />Section 1325.04 of the Zoning Code regulates the location and site development standards of <br />drive-in businesses in addition to the special regulations for the B-3 District. In addition to the <br />location requirement that drive-in businesses cannot be closer than 1,320 feet from one another, <br />flexibility would be needed from the following provisions in this section: <br /> <br />• Landscaping: a minimum landscaped area of 15 feet is required from the rear lot line. <br />Approximately 5 feet of landscaped area is provided along the Phase 2 rear property line. <br />• Electronic Devices: electronic devices, such as loudspeakers, must be 50 feet from any <br />adjacent lot. The menu board for the Phase 2 building would be approximately 30 feet <br />from the rear property line. <br /> <br />C. Landscaping and Tree Preservation – Section 1325.05 Subd. 1 and 1325.055 <br /> <br />Minimum Caliper Inches and Tree Ratio – Exceeds Requirements <br />The Landscape Plan for Phase 2 and is included in Attachment E. Based on the square footage of <br />the proposed building, the City Code requires 53.1 caliper inches of trees be planted. <br />Additionally, the Tree Preservation Plan indicates that 63 caliper inches of significant trees will <br />be removed. The mitigation requirement for the removal is 28 caliper inches. Between the new <br />tree plantings for the Phase 2 building and the mitigation requirements, a total of 81.1 caliper <br />inches are required. The Landscape Plan shows a total of 84 caliper inches of new trees. The <br />following table outlines these numbers. <br />
