If the proposed development is <br />approved, the City will reclassify this property in the 2030 Future Land Use Map as Very Low <br />Density Residential. <br /> <br />F. Setbacks <br /> <br />The minimum building setbacks in the R-2 District are 40 feet in the front yard, 30 feet in the <br />rear yard, and a 5-foot minimum in the side yard, with both sides required to add up to a <br />minimum of 15 feet. Based on the site plan provided, all setback requirements stated in the <br />Zoning Code would be met by the proposed Ernie Nelson Estates development. <br /> <br /> <br />Section 1325 – General Regulations <br /> <br />A. Accessory Structures <br /> <br />No accessory structures are proposed at this time. Future homeowners who choose to construct <br />accessory structures will be required to do so in accordance with the Zoning Code. <br /> <br />B. Tree Preservation <br /> <br />There are several significant trees on the property that would be removed during demolition of <br />the fire station structure and the grading of the site for residential building pads. The applicant <br />has not submitted a Tree Preservation Plan. A recommended condition of approval is that a Tree <br />Preservation Plan in accordance with the City Code requirements be submitted before City <br />Council approval. The applicant may be required to provide mitigation for the removed trees <br />based on the completed Tree Preservation Plan. <br /> <br /> <br />Section 1355.04 Subd. 4 - Variance Requirements <br /> <br />The applicant has requested a Variance from the R-2 District minimum lot width requirement of <br />85 feet to a reduced standard of 81.75 feet. This reduced width would allow for a four lot <br />subdivision. If the Variance is not approved, the plat would need be reduced to three lots to <br />comply with the 85-foot width requirement. As background, staff has reviewed the lot widths of <br />the 30 existing residential lots within this block (Attachment D). Nine of the lots have a lot width <br />less than the 85-foot requirement and eight lots have a width less than the 81.75 feet requested by <br />the applicant. Additionally, the majority of the lots west of New Brighton Road are <br />approximately 75 feet wide and are also zoned R-2 District. <br /> <br />The Planning Commission and City Council must use the following criteria when reviewing a <br />request for a Variance: <br />
