Page 1 of 2 NEW BUSINESS – 9A MEMORANDUM DATE: July 8, 2019 TO: Honorable Mayor and City Councilmembers Dave Perrault, City Administrator FROM: Julie Hanson, Clerk SUBJECT: Amend Chapter 3, License and Regulations, Section 350, Tobacco Products, Subsection 350.06, Prohibited Sales and Publication of Ordinance Amendment Budgeted Amount: Actual Amount: Funding Source: $ $ $ For Council Consideration Following the Public Hearing and discussion, Council may choose to take action on proposed Ordinance 2019-005 amending Chapter 3, License and Regulations, Section 350, Tobacco Products, Subsection 350.06, Prohibited Sales, and authorize the publication of the Ordinance amendment. Background The City Council has discussed this item at previous work sessions and also provided the opportunity for formal public input from the tobacco sales vendors as well as the general public (see this evening’s Public Hearing item 8A memorandum). Following City Council direction, staff presented proposed draft language amendments to Chapter 3, Section 350 at the March 25, 2019 meeting that included raising the age to purchase tobacco to 21 and regulating (banning) the sales of flavored products (fruit, candy, gum, wintergreen, mint, menthol, etc.) in the city as a whole, including adult-only tobacco establishments. The Council adopted Ordinance 2019-003 at its March 25 meeting. At the May 20, 2019 City Council work session, the City Council directed staff to bring forward a draft ordinance amendment that would exempt the current adult-only tobacco store from the previously approved flavor ban. Discussion The current proposed amendment’s language (see Attachment A) pertains to Subsection 350.06, Prohibited Sales, and states that “After August 1, 2019, the flavor restriction shall not apply to any
