Page 1 of 2 <br /> <br /> <br />NEW BUSINESS – 9A <br /> <br />MEMORANDUM <br /> <br />DATE: July 8, 2019 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Julie Hanson, Clerk <br /> <br />SUBJECT: Amend Chapter 3, License and Regulations, Section 350, Tobacco Products, <br />Subsection 350.06, Prohibited Sales and Publication of Ordinance Amendment <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> $ $ $ <br /> <br />For Council Consideration <br />Following the Public Hearing and discussion, Council may choose to take action on proposed <br />Ordinance 2019-005 amending Chapter 3, License and Regulations, Section 350, Tobacco <br />Products, Subsection 350.06, Prohibited Sales, and authorize the publication of the Ordinance <br />amendment. <br /> <br />Background <br />The City Council has discussed this item at previous work sessions and also provided the <br />opportunity for formal public input from the tobacco sales vendors as well as the general public <br />(see this evening’s Public Hearing item 8A memorandum). <br /> <br />Following City Council direction, staff presented proposed draft language amendments to Chapter <br />3, Section 350 at the March 25, 2019 meeting that included raising the age to purchase tobacco to <br />21 and regulating (banning) the sales of flavored products (fruit, candy, gum, wintergreen, mint, <br />menthol, etc.) in the city as a whole, including adult-only tobacco establishments. The Council <br />adopted Ordinance 2019-003 at its March 25 meeting. <br /> <br />At the May 20, 2019 City Council work session, the City Council directed staff to bring forward a <br />draft ordinance amendment that would exempt the current adult-only tobacco store from the <br />previously approved flavor ban. <br /> <br />Discussion <br />The current proposed amendment’s language (see Attachment A) pertains to Subsection 350.06, <br />Prohibited Sales, and states that “After August 1, 2019, the flavor restriction shall not apply to any
