Drug Testing <br />Current Language (page 20): <br />Every job applicant offered employment with the city receives the offer conditioned upon <br />successful completion of a drug test... Temporary and seasonal employees are also subject to this <br />policy. <br />Proposed Language: <br />Full-time and temporary/seasonal employees in safety sensitive positions as determined by the <br />City Administrator will be subject to drug testing upon receiving a conditional job offer. <br />This change will better reflect current practice. Historically, the City has only drug tested the <br />Public Works employees as they are required to hold a Commercial Driver's License as part of <br />their job and the Public Works seasonal employees; other full-time and seasonal employees have <br />not been subject to testing. While the City could test full-time employees, it would be <br />logistically difficult to also test recreational seasonal employees as they begin and terminate <br />employment with the City sporadically. <br />An updated Commercial Driver License Drug and Alcohol Testing Policy is also being proposed <br />(see Attachment Q. This policy is based on the League of Minnesota Cities model policy and <br />ensures the City meets all local, state, and federal guidelines. <br />Hands Free Driving <br />Current Language (page 30): <br />The City expects all employees who are required to drive as part of their job to drive safely and <br />legally when on City business and to maintain a good driving record. <br />Proposed Language: <br />The City expects all employees who are required to drive as part of their job to drive safely and <br />legally when on City business and to maintain a good driving record. This includes, but is not <br />limited to, the below rules regarding cell phone usage and driving: <br />-Reading/sending text messages, making or receiving phone calls, emailing, video <br />calling, scrolling/typing, accessing a webpage, or using non -navigation applications <br />while driving is strictly prohibited. <br />-In accordance with State law, there is an exception to hands free cell phone operations <br />to obtain emergency assistance to report a traffic accident, medical emergency or serious <br />traffic hazard or prevent a crime from being committed. There is also a State law <br />exception for authorized emergency vehicles while in the performance of official duties. <br />-Employees who are charged with traffic violations resulting from the use of their phone <br />while driving will be solely responsible for all liabilities that result from such actions. <br />-Any incidents of violation of the hands-free law witnessed by other staff or <br />Councilmembers will be recorded in the employee's personnel file and the employee may <br />be subject to discipline up to and including termination. <br />
