____________________________________________________________________________________________ <br />City of Arden Hills <br />Planning Commission Meeting for September 9, 2020 <br />P:\Planning\Planning Cases\2020\20-010 4200 Round Lake Road PP/FP/CUP/PUD\PC Packets <br />Page 3 of 13 <br />The subdivision ordinance requires streets serving commercial and industrial areas to have a right <br />of way (ROW) width of70 feet. As part of the platting process the Applicant is required to dedicate <br />approximately .41 acres or approximately 17,860 square feet of ROW along Gateway Boulevard <br />to the City. This dedication of ROW impacted parking lot setbacks. The GB zoning district <br />requires a 50 foot setback from public streets. The applicant was requesting a 30 foot parking lot <br />setback from Gateway Boulevard and due to the required ROW dedication the Applicant is now <br />requesting a 20 foot setback to the parking area on the north side of the subject parcel. However, <br />serval properties along Round Lake Road and Gateway Boulevard have similar or greater <br />reduction in parking lot setbacks. <br />C. Park Dedication <br />City Code 1130.08 requires that all subdivisions dedicate land to the City for a public use as a <br />condition of approval for the development. In commercial or industrial subdivisions where a land <br />dedication is required, seven and a half (7.5) percent of the gross area of the subdivision shall be <br />used to determine the parkland dedication. For the 21.94 acre development proposed, a 1.64 acre <br />park dedication would be required. A cash contribution in lieu of land dedication may be required <br />at the discretion of the City. The cash contribution fee shall be seven and a half (7.5) percent of <br />the fair market value of the unimproved land. Cash contributions for land dedication or park <br />improvements are to be calculated at the time of the Final Plat approval. The City may require the <br />payment prior to the release of the Final Plat or at a later time under terms agreed upon in the <br />development agreement. Park dedication for Lot 2 will be determined at the time of development. <br />D. Required Improvements <br />All other required improvements, including sewer, water, utilities, and driveway connections to <br />Gateway Boulevard will be constructed in accordance with the City’s Subdivision Code. As a <br />condition of approval, engineering staff shall review and approve final utility and grading plans <br />prior to the issuance of a grading and erosion permit.
