Easements and Right of Way <br />The Subject Parcel requires several easements as part of this proposal. The Subject Property is <br />encumbered by existing sightline easements with Clear Channel for two (2) billboards and an <br />overhead power line easement. In addition, the site has existing wetlands located adjacent to 35W <br />and 694 that require drainage and utility easements be placed over the wetlands. <br />The subdivision ordinance requires streets serving commercial and industrial areas to have a right <br />of way (ROW) width of 70 feet. As part of the platting process the Applicant is required to dedicate <br />approximately .41 acres or approximately 17,860 square feet of ROW along Gateway Boulevard <br />to the City. This dedication of ROW impacted parking lot setbacks. The GB zoning district <br />requires a 50 foot setback from public streets. The applicant was requesting a 30 foot parking lot <br />setback from Gateway Boulevard and due to the required ROW dedication, the Applicant is now <br />requesting a 20 foot setback to the parking area on the north side of the subject parcel. However, <br />several properties along Round Lake Road and Gateway Boulevard have similar or greater <br />reduction in parking lot setbacks. <br /> <br />C. Required Improvements <br />All other required improvements, including sewer, water, utilities, and driveway connections to <br />Gateway Boulevard will be constructed in accordance with the City’s Subdivision Code. As a <br />condition of approval, engineering staff shall review and approve final utility and grading plans <br />prior to the issuance of a grading and erosion permit. <br />
