<br />4 <br />211828v2 <br />Development Agreement shall be prepared by the City Attorney and subject to City Council <br />approval. The Development Agreement shall be fully executed prior to release of the Final <br />Plat. <br />19. The garage portion of the home facing the street shall not exceed fifty (50) percent of the <br />total front façade. <br />20. The buildable area shall be 10,200 square feet instead of the total lot area when calculating <br />the FAR for each lot. <br />21. The maximum peak of the roof should be no more than 35 feet. <br />22. Prior to the release of the Final Plat for recording, the Applicant shall enter into a <br />Development Agreement. <br />23. All permanent easements and rights-of-way (ROW) necessary for existing street and utility <br />improvements shall be granted to the City at no cost or paid for by the Developer. <br />24. The Developer shall be financially responsible for 100 percent of all storm sewer, sanitary <br />sewer and water main area and connection charges applicable to the property. These <br />charges are identified in a preliminary report prepared for the project and shall be in the <br />Development Agreement. <br />25. Final Plat approval shall expire six months from the date of the City Council approval <br />unless the Final Plat has recorded with Ramsey County or a time extension granted by the <br />City Council. <br /> 5. DEVELOPMENT PLANS. The plat shall be developed in accordance with the <br />following plans, which will be retained in Arden Hills Planning File No. PC 20-003. The plans shall not <br />be attached to this Contract. The erosion control plan may also be approved by Ramsey County and the <br />Rice Creek Watershed District. If the plans vary from the written terms of this Contract, the written terms <br />shall control. The plans are: <br />Plan A – Certificate of Survey, dated 04/09/2020 <br />Plan B – Preliminary Plat, dated 04/09/2020 <br />Plan C – Title Sheet (C1), dated 04/09/2020 <br />Plan D – Removal Plan (C2), dated 03/18/2020 <br />Plan E – Civil Site and Utility Plan (C3), dated 05/15/2020 <br /> Plan F – Grading, Drainage, and Erosion Control Plan (C4), dated 05/01/2020 <br /> Plan G – Details (C5.1), dated 04/09/2020 <br /> Plan H – Details (C5.2), dated 05/01/2020
