Section 1320.12, Subd. 1, D, states “The provisions in this <br />Section may be modified by the City Council to allow planning flexibility without the need for a <br />variance to encourage cooperative dialogue between the applicant and the City. Minor <br />improvements to existing uses should be encouraged without costly upgrades or complete changes <br />to a site.” <br /> <br />B. Height – Meets Requirements <br /> <br />The maximum building height in the I-Flex District is 45 feet. The current building is 42’ in height <br />to the peak of the existing roof. No change is proposed to the existing building height. <br /> <br />C. Setbacks – Meets Requirements <br /> <br />Setbacks in the I-Flex District are 50 feet for the front yard, 20 feet for the side yard with minimum <br />of 40 feet total for both side yards, and 20 feet for the rear yard. Accessory Uses – Section 1325.02 <br />Section 1325.02 of the Zoning Ordinance allows accessory uses, such as retail sales and personal <br />services in the I-Flex district “when such uses are directly associated with the principal use, and <br />when such accessory uses are clearly incidental.” Day care facilities for over 10 persons are <br />considered an accessory use for houses of worship. <br /> <br />The applicant’s floor plan (Attachment E) identifies a coffee lobby and a bookstore. The narrative <br />(Attachment A) notes the intent is to allow congregants and guests the opportunity to purchase <br />coffee and light snacks before and after services. The bookstore is also intended to serve <br />congregants. Staff has recommended a condition of approval of the CUP state that coffee or snack <br />sales only be allowed one hour before and after services. <br /> <br />The applicant has not included plans for a daycare at this time. <br /> <br />B. Landscaping and Tree Preservation – Section 1325.05 Subd. 1 and 1325.055 <br /> <br />Minimum Caliper Inches and Tree Mitigation – Meets Requirements <br />The Zoning Code requires that a minimum number of caliper inches of trees be provided based on <br />the gross square footage of the building on the property. The proposed building includes 74.636 <br />gross square feet. This requires a minimum of 233 caliper inches. Section 1325.055, Subd. 6, 3, e,
