<br />. <br /> <br />WHEREAS, the aforementioned agreement requires that' the OWner retain a <br />consulting engineering firm, in accordance with U.S. Environmental <br />Protection Age~cy (EPA) rules and regulations governing subagreements <br />to conduct, or assist in conducting, the detailed infiltration/inflow <br />analysis studYI and <br /> <br />WHEREAS, the OWner desires to employ the Engineer to provide <br />professional engineering services to conduct the necessary <br />investigations and analyses of the OWner's sanitary sewer system, in <br />accordance with guidelines and regulations published as of February 1, <br />1980, by the U.S. Environmental Protection Agency concerning sewer <br />system evaluation and rehabilitation. <br /> <br />NOW, THEREFORE, in consideration of the promises and the covenants, <br />agreements and payments hereinafter set forth, the Owner and the <br />Engineer hereby mutually agree as follows: <br /> <br />ARTICLE I - DESCRIPTION OF PROJECT <br /> <br />. <br /> <br />This project shall include the completion o,f an infiltration/inflow <br />analysis study of the Owner's sanitary sewer system. This study will <br />demonstrate the nonexistence or possible existence of excessive <br />infiltration/inflow (I/I) in the sewer system. The study will <br />identify the presence, flow rate, and type of I/I which exists in the <br />sewer system. It shall also include an estimate of the cost of <br /> <br />- 2 - <br />
