<br />ARDEN HILLS REGULAR CITY COUNCIL MEETING MINUTES <br />MAY 28, 2002 <br /> <br />6 <br /> <br />. <br /> <br />MOTION: Council Member Larson moved and Council Member Aplikowski <br />seconded a motion to substitute the first motion with the following <br />"Space for park activity shall take precedence over use for ponding, <br />specifically with respect to Valentine Park". Substitute motion carried <br />unanimously (5-0), <br /> <br />C. Planning Case 02-07: Goserud Preliminary Plat <br /> <br />City Planner Parrish explained that the applicant was requesting approval of a <br />preliminary plat to divide one existing lot zoned R-l Single Family Residential <br />into two lots zoned R-l Single Family Residential. The applicant was also <br />requesting a variance to allow for a private access and a variance to allow an 8-foot <br />accessory structure setback where 10 feet was required. He stated the Planning <br />Commission recommended denial ofthe preliminary plat and platting variances, <br /> <br />. <br /> <br />Council Member Larson asked how there was an adverse affect to adjacent <br />property owners, Mr. Parrish replied there was no adverse affect to the adjacent <br />property owners. <br /> <br />Mayor Probst asked what the City Code said with respect to flag lots. Mr. Parrish <br />replied if there was a flag lot, they needed to address an access issue and certain <br />street frontage issues, but the Code did not specifically prohihit flag lots, <br /> <br />Tom Goserud, 4350 Hamline Avenue, stated they did not have a drainage problem. <br />He stated he did not understand why this became an issue at the Planning <br />Commission meeting, He indicated there were a lot of trees, grass, and shrubs <br />growing along the southern property line and there were no drainage issues. He <br />stated there would be no trees removed if this were approved. He presented the <br />background on his property and stated the City had landlocked his property <br />through various past actions, He indicated this may not be an ideal proposal, but it <br />was the best that could be done with the property at this time. <br /> <br />Council Member Grant asked if the driveway would be a separate driveway, Mr. <br />Goserud stated they would use the same curb cut, but then split off. <br /> <br />. <br /> <br />Council Member Larson asked if this proposal went forward, was Mr. Goserud <br />going out of the nursery business, Mr. Goserud stated they would not have the <br />nursery business on the property if this were approved, <br />
