The new vinyl fence <br />would not be located directly on the property line due to existing easements. The proposed fence <br />on the south property line extends easterly to the 20-foot parking setback line as measured from <br />the front property line. The Applicant is not proposing a fence along the north property line due <br />to the shared cross access easement with the adjacent property. Fences in the B-3 District shall <br />blend into the landscape or be compatible with other materials used on site. This district <br />encourages use of finished and treated wood, brick, stone, or wrought iron. The Planning <br />Commission should comment as part of the review if the proposed screening is sufficient. <br /> <br />E. Landscaping – Flexibility Requested <br />Section 1320.06 – District Requirements Chart of the City Code requires a minimum landscape <br />lot area of 25% or 13,612.5 square feet for the Subject Property in the B-3 District. The <br />Applicant is proposing a landscape lot area of approximately 35.2% percent or 19,166 square <br />feet. Additionally, at least 10% or 1,916.6 square feet of the total landscaped area (i.e. 19,166 <br />square feet) shall be covered with perennials and/or shrubbery. The Applicant is proposing <br />perennial and/or shrubbery of approximately 12.9% or 2,474 square feet. Planting islands shall <br />occupy 10% or 2,041 square feet of the parking area (i.e. 20,411 square feet). The plans show the <br />provided planting islands are below the requirement with 1,178 square feet and require <br />flexibility. <br /> <br />The site contains approximately 311 caliper inches of significant trees. Section 1325.055 Subd. 5 <br />allows for the removal of fewer than ten (10) percent of the caliper inches of significant trees on <br />the property without requiring mitigation. Ten percent of 311 is 31.1 caliper inches. The <br />Applicant proposes removing 244 caliper inches of trees, meaning the Applicant is responsible <br />for mitigation of 212.9 caliper inches removed above 10 percent. Per Section 1325.055 Subd 6, <br />the number of caliper inches of trees required for replanting is determined at a rate of 1:2 or one <br />inch replaced for every two inches lost. The Applicant cites the relatively <br />small size of the site, the large number of caliper inches that need to be replaced and the <br />percentage of the site that has existing parking, access and utility easements as reasons for not <br />planting the total caliper inches for required for replacement on site. The Applicant has included <br />an estimate for the proposed fee in lieu of plantings. If this is acceptable to the Planning <br />Commission, the Applicant would be required to provide an estimate of cost of materials and <br />installation of trees. The landscaping fee collected is calculated based on those costs, plus 10%. <br /> <br />The City Code requires a minimum of one (1) tree be provided along the right-of-way of every <br />40 feet of public street frontage. The proposed development would be required to plant three (3) <br />trees along the Lexington Avenue right-of-way which the Applicant has satisfied in their <br />landscaping plan. Also under Section 1325.04, Subd, 2, the City has depth requirements as <br />measured from the property line for landscaping on lots used for drive-thru which have been met. <br />A landscape plan is included as Attachment D. <br />
