First when there are more than 25 residents requesting a EA W, the governing unit shall <br />order the study. Secondly, issues regarding the protected wetlands if sump pump problems arise. <br /> <br />Mr. Chapin indicated an EA W is required if a wetland is affected. He indicated in his research, <br />whenever a City has ordered an EA W, no court has reversed a decision of a Council to order an <br />EAW. <br /> <br />Mr. Chapin suggested an EA W be done, public comment be heard and then the Council will be <br />better equipped to make a decision. <br /> <br />Mr. Chapin indicated the attorney for the ''Neighbors of V alentine Lake", Tom Casey will contact <br />the City Attorney to address these issues. <br /> <br />Ms. Fran Holmes of1804 Venus Avenue, referred to the memomndum of Mr. Bergly dated March <br />1, 1995 regarding Planning Case #95-5 to the Council, she indicated after reviewing she felt there <br />were issues still to address. <br /> <br />Ms. Holmes indicated regarding the Comprehensive Plan and this project, the project is not a <br />compatible use with the surrounding wetlands, there is not buffering for the proposed project, and <br />also indicated the calculation for the density was incorrect. <br /> <br />Ms. Holmes indicated concern that the street width should be 32 feet and not 26 feet. She noted <br />concern that units 8, 9 and 10 would cross the County easement noted on the map. She felt drainage <br />issues still need to be addressed. She indicated through a soil survey it is not recommended for <br />developing. She stated a traffic study should be done and indicated an article from the Valentine <br />Hills School, noted County Road E-2 to be a hazardous roadway currently, even without this <br />proposed development. <br /> <br />Ms. Holmes indicated did not feel the Planning Commission fully reviewed the Comprehensive <br />Land Use Plan regarding this project. <br /> <br />Mr. Craig Wilson of 1677 County Road F, a member of ''Neighbors of V alentine Lake" indicated <br />he has been working with County Commissioner Wedell. He indicated Mr. Gregory Mack, Director <br />of Parks for the County, had expressed in a letter, when the land becomes available, he would <br />recommend the County accept it as a contribution to Ramsey County Open Space. <br /> <br />Ms. Doris Canniff of 3946 Glenview Avenue, indicated she had not seen any "for sale" signs on <br />the property. She indicated concern for overdevelopment. She also indicated concern for mistrust <br />between the community and the City Council. Her desire is to remain proud of this neighborhood <br />and does not feel this would be beneficial to this neighborhood. <br />
