<br />I <br />I.' <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I- <br />I <br /> <br />,8.R1)EN IllLLS CITY COUNCIL - APlUL 24, 1994 <br /> <br />3 <br /> <br />Mr. Fritsinger indicated the Council should note Section 3.0(A) of the Development Agreement. <br />Previously the consultant planner recommended approval of this proposal subject to a joint PUD <br />application on the overall site by CSM, Control Data and Dynamark:. Further negotiations between <br />representatives of these finns and the City Attorney have resulted in language which does not require <br />a joint application. <br /> <br />Mr. Fritsinger indicated additional information is also found in the April 5, 1995 Planning <br />Commission Meeting Minutes. <br /> <br />Councilmember Keim inquired if the road accessing the properly will be a private road. Mr. <br />Fritsinger indicated this would be correct. <br /> <br />Councilmember Keim asked if the City would be creating a land locked parcel. Mr. Fritsinger <br />indicated this would not be the case, there is still access to Lexington Avenue and access easements <br />will also be created. <br /> <br />Mayor Probst asked if there will still be an easement for access to Cnmmings Park. Mr. Fritsinger <br />stated yes, there would still be an easement. <br /> <br />MOTION: <br /> <br />Malone moved and Aplikowski seconded a motion to approve Planning Case #95-11, <br />Control Data - Minor Subdivision with the stated conditions. The motion carried <br />nnanimously (5-0). <br /> <br />Planning Case #95-09. CSM - Site Plan Review <br /> <br />Mr. Fritsinger referred to the Planning Commission meeting minutes of April 5, 1995, and indicated <br />the concern regarding the NURP Pond. Mr. Fritsinger said it was his understanding that after a <br />meeting with Rice Creek Watershed District and CSM, Mr. Bergly, the Planning Consultant stated <br />there is no requirement for a holding pond. Mr. Fritsinger indicated the applicant is sti11 planning <br />on installing a fence. <br /> <br />Councilmember Hicks asked what the elevation of the pond would be. Mr. Fritsinger indicated the <br />pond will hold only minimal water, unlike a sediment or holding pond. <br /> <br />Ms. Lori Johnson, civil engineer for the project, indicated the volume of the pond would be for two <br />to two and one-half inches of rainfall. She indicated this amount could fluctuate with the weather. <br /> <br />CounciImember Aplikowski inqnired as to where the fencing would be. Mr. Fritsinger pointed out <br />the fencing would surround the pond area. <br /> <br />Mayor Probst asked if the future building would have docking areas for trucks. Mr. Dave Carland <br />from CSM Corp. indicated the second building will look virtually like the first building. <br />
