Minutes of the Arden Hills Regular Council Meeting, February 27, 1989 .Page 3 LICENSES (Cont'd) Councilmember Malone stated that from the information provided from the hauler in question it appears the company is operating in the spirit of the regulation. There was discussion relative to any complaints relating to the haulers. . Berger advised the only complaints he has received directly relate to the haulers not providing the recycling discount. He explained the haulers advised the problems are related to the container size; the haulers are ordering new containers and the problem should be eliminated. Malone moved, seconded by Hansen, that Council approve the 1989 Refuse/Garbage Collectors licenses as submitted by the Clerk Administrator. Motion carried unanimously. (4-0) RENTAL SPACE ON WATER TWR; CELLULAR ONE Council was referred to a memorandum from Berger dated 2-16-89; relative to Cellular One renting space on the City Water Tower. Berger advised a survey was conducted relative to the fees charged by other communities for similar rental and a copy of a standard rental agreement had been reviewed by the City Attorney. A memorandum was received from the attorney indicating the agreement is in a form that could be executed by Arden Hills upon Council determination of the term, renewal and rent. . The Clerk Administrator suggested the Council refer the site plan to Planner Bergly for his review. Bryan Rodgers, Cellular One, was present to discuss how the cable and antenna is installed, screening of the site and rental fees. Rodgers suggested a rental fee of $500.00 per month for the cellular antennae and $50.00 per month, per microwave dish to be charged on an individual basis upon installation. Malone moved, seconded by Hansen, that staff and Planner Bergly be directed to negotiate and prepare for Council consideration a rental agreement with Cellular One representatives as relates to the following items: 1. Building placement and aesthetics; 2. Antenna structures; 3. Landscaping; and 4. Rental fees. Motion carried unanimously. (4-0) REQ. RELEASE OF RT. OF WAY; CO. RD. E-2 & NEW BRIGHTON RD. Council was referred to the Clerk Administrator's memorandum of 2-24-89, relative to release of excess right-of-way on the southwest corner of County Road E-2 and New Brighton Road. . Clerk Administrator Berger gave a brief history of the request and advised that staff had discussed this matter with the Village Attorney and Planner and representatives from Ramsey County Public Works Department. He recommended Planner Bergly's step outline listed in his memorandum of 2-15-89 should be followed, if Council approves proceeding with the acquisition of the excess right-of-way. Councilmember Malone questioned if the City would purchase the right-of-way. Berger advised the County releases the right-of-way to the City and there are no fees involved; the City Planner would then review the area to determine easements required and staff would process application for a minor subdivision from the adjacent property owners. Malone moved, seconded by Hansen, that Council direct the Clerk Administrator to contact the District Engineer of Ramsey County and proceed with the acquisition of the excess right-of-way at the southwest corner of County Road E-2 and New Brighton Road. Motion carried unanimously. (4-0) TRAF. SIGNAL; GREY FOX/ISLAND LK. REALIGNMENT Council was referred to a memorandum from Berger dated 2-24-89, regarding the traffic study, signalization and realignment at the intersection of Grey Fox Road and Island Lake Avenue. . The Clerk Administrator advised Planner Bergly has reviewed the proposal and conducted an on-site inspection. Council was referred to a letter from Bergly dated 2-24-89 and a proposed alternative for alignment of the streets. Council preferred the alignment proposed by Bergly; concurred it would be a much better arrangement to accommodate traffic flow.
