Minutes of the Arden Hills Regular Council Meeting, February 27, 1989 Page 4 GREY FOX (Cont'd) Council directed the Clerk Administrator to forward the proposed sketch from Bergly to the City of Shoreview with correspondence stating Arden Hills preference for the arrangement prepared by Bergly. Although it may prove more costly for Shoreview to obtain the necessary land, it would appear to be a safer and better arrangement for traffic. Mayor Sather requested the Shoreview Planner review the proposal and return . comments or alternatives to Arden Hills. REQ. TO PROVIDE UTILITIES TO TCAAP; CITY OF SHOREVIEW to provide utilities to Council was referred to a memorandum from Berger dated 2-24-89 and a letter from Attorney Lynden dated 2-23-89, regarding the request from the City of Shoreview for Arden Hills review and comments on the proposed agreement the Army Reserve on the Arsenal. The Clerk Administrator stated the Attorney had reviewed the agreement and approval is only based on the agreement between the Army Reserve and City of Shoreview; Berger explained it is not meant to include his approval of the provision for Shoreview to provide utilities to the Arsenal located in Arden Hills. Berger recommended Council action on this matter be held until Arden Hills has retained legal counsel to advise on the legal ramifications of the agreement; he explained it would be a conflict of interest to have Attorney Filla review the document. Council' concurred and directed Berger to notify Shoreview that no action would be taken on this matter until such time as Arden Hills has retained legal counsel to . review the agreement. RENTAL AGREEMENT; RICE CREEK WTRSHED Council was referred to a memorandum dated 2-22-89, relative to a rental agreement with Rice Creek Watershed for use of the City Hall facility. The Clerk Administrator advised the City has no written agreement with RCWD and staff raised questions regarding the use of the facility; noting inconvenience due to duplication of meetings, clean-up and set-up of the Council chambers, and the rental fee. Councilmember Malone suggested staff conduct a survey to determine what the market supports for rental fees for municipal facilities. Mayor Sather suggested staff could advise RCWD of the possibility they may be inconvenienced and may have to meet in another building. Councilmember Hansen was not opposed to staff preparing a written agreement or surveying other cities to determine fair rental fees; she expressed opposition to advising RCWD the City facilities would not be available for their use. Council concurred to direct staff to survey other communities to determine a fair . rental fee for the City facilities and to prepare a written agreement for use of the facilities. RES. #89-14; KEM MILLING PROP. ACQUISITION Council was referred to the resolution prepared by Attorney Lynden, relating to the City acquisition of the Kern Milling property. Clerk Administrator Berger advised Attorney Filla had reviewed and approved the resolution; he advised the resolution states Arden Hills' intention in terms of a development district and makes explicit the City concerns relative to an environmental audit, as recommended by Attorney Lynden. Malone moved, seconded by Growe, that Council adopt Resolution No. 89-14, Authorizing City's Acquisition of Kem Milling's Property Southwesterly of Round Lake Subject To Certain Conditions. Motion carried. (4-0) Council discussed the availability of funds to purchase the Kern Milling property. Treasurer Green advised the monies should be available within the next few months. CLAIMS & PAYROLL Hansen moved, seconded by Malone, that Council approve Claims and Payroll as submitted. Motion carried. (4-0) .
