<br />Minutes of the Arden Hills Regular Council Meeting, February 27, 1989 <br />Page 4 <br /> <br />GREY FOX (Cont'd) Council directed the Clerk Administrator to forward <br />the proposed sketch from Bergly to the City of Shoreview <br />with correspondence stating Arden Hills preference for the arrangement prepared <br />by Bergly. Although it may prove more costly for Shoreview to obtain the <br />necessary land, it would appear to be a safer and better arrangement for traffic. <br />Mayor Sather requested the Shoreview Planner review the proposal and return . <br />comments or alternatives to Arden Hills. <br /> <br />REQ. TO PROVIDE <br />UTILITIES TO TCAAP; <br />CITY OF SHOREVIEW <br /> <br />to provide utilities to <br /> <br />Council was referred to a memorandum from Berger dated <br />2-24-89 and a letter from Attorney Lynden dated 2-23-89, <br />regarding the request from the City of Shoreview for <br />Arden Hills review and comments on the proposed agreement <br />the Army Reserve on the Arsenal. <br /> <br />The Clerk Administrator stated the Attorney had reviewed the agreement and <br />approval is only based on the agreement between the Army Reserve and City of <br />Shoreview; Berger explained it is not meant to include his approval of the <br />provision for Shoreview to provide utilities to the Arsenal located in Arden <br />Hills. <br /> <br />Berger recommended Council action on this matter be held until Arden Hills has <br />retained legal counsel to advise on the legal ramifications of the agreement; he <br />explained it would be a conflict of interest to have Attorney Filla review the <br />document. <br /> <br />Council' concurred and directed Berger to notify Shoreview that no action would be <br />taken on this matter until such time as Arden Hills has retained legal counsel to . <br />review the agreement. <br /> <br />RENTAL AGREEMENT; <br />RICE CREEK WTRSHED <br /> <br />Council was referred to a memorandum dated 2-22-89, <br />relative to a rental agreement with Rice Creek Watershed <br />for use of the City Hall facility. <br /> <br />The Clerk Administrator advised the City has no written agreement with RCWD and <br />staff raised questions regarding the use of the facility; noting inconvenience <br />due to duplication of meetings, clean-up and set-up of the Council chambers, and <br />the rental fee. <br /> <br />Councilmember Malone suggested staff conduct a survey to determine what the <br />market supports for rental fees for municipal facilities. <br /> <br />Mayor Sather suggested staff could advise RCWD of the possibility they may be <br />inconvenienced and may have to meet in another building. <br /> <br />Councilmember Hansen was not opposed to staff preparing a written agreement or <br />surveying other cities to determine fair rental fees; she expressed opposition to <br />advising RCWD the City facilities would not be available for their use. <br /> <br />Council concurred to direct staff to survey other communities to determine a fair . <br />rental fee for the City facilities and to prepare a written agreement for use of <br />the facilities. <br /> <br />RES. #89-14; <br />KEM MILLING <br />PROP. ACQUISITION <br /> <br />Council was referred to the resolution prepared by <br />Attorney Lynden, relating to the City acquisition of the <br />Kern Milling property. <br /> <br />Clerk Administrator Berger advised Attorney Filla had reviewed and approved the <br />resolution; he advised the resolution states Arden Hills' intention in terms of a <br />development district and makes explicit the City concerns relative to an <br />environmental audit, as recommended by Attorney Lynden. <br /> <br />Malone moved, seconded by Growe, that Council adopt <br />Resolution No. 89-14, Authorizing City's Acquisition of Kem Milling's Property <br />Southwesterly of Round Lake Subject To Certain Conditions. Motion carried. (4-0) <br /> <br />Council discussed the availability of funds to purchase the Kern Milling property. <br /> <br />Treasurer Green advised the monies should be available within the next few <br />months. <br /> <br />CLAIMS & PAYROLL <br /> <br />Hansen moved, seconded by Malone, that Council approve <br />Claims and Payroll as submitted. Motion carried. (4-0) <br /> <br />. <br />
