(Cont'd) Berger distributed copies of Kriesel's application for <br />Council review and he recommended hiring Kriesel at the <br />staring salary of $22.50 per hour, the second step of the salary schedule <br />approved by Council. He noted that Kriesel has a Class B license and would be <br />able to perform the duties of the heating and plumbing inspectors in their <br />absence. <br /> <br />. <br /> <br />There was discussion regarding the number of hours for the position; Berger <br />advised the current inspector worked approximately 20 hours per week and he <br />suggested reviewing the number of hours necessary to accomplish code <br />enforcement prior to making a recommendation for additional hours. <br /> <br />Hansen moved, seconded by Malone, that Council approve <br />the appointment of David Kriesel as Building Inspector/Code Enforcement Officer, <br />authorize the starting salary at $22.50 per hour, as recommended by the Clerk <br />Administrator. Motion carried unanimously. (4-0) <br /> <br />DISC; CHARITABLE <br />GAMBLING ORDINANCE <br /> <br />Council was referred to a memorandum from Berger dated <br />2/2/89, requesting direction relative to completion of <br />the draft Charitable Gambling Ordinance. <br /> <br />Berger stated he had contacted the League of Cities for preliminary research and <br />referred Council to three items in his memorandum whereby the City could impose <br />regulations; he advised Council consider holding this item until the close of the <br />legislative session. <br /> <br />. <br /> <br />Jim Adams, Pot 0 Gold Bingo Hall, discussed the proposed legislation and <br />requested Council consider allowing one additional Class B license; he stated <br />there are three liquor establishments in the City and only 2 Class B licenses are <br />currently available under the moratorium. Adams also discussed the recently <br />enacted North Dakota Law; the law directs primary responsibility for running <br />charitable gambling to the charitable organizations and gives the State primary <br />responsibility for regulating the use of lawful purpose monies and insuring taxes <br />are paid. <br /> <br />After discussion, Council concurred to direct the Clerk Administrator and <br />Attorney to prepare a draft Charitable Gambling Ordinance for Council review in <br />June 1989, pending review of any new legislation that would affect the ordinance, <br />and including the three items listed in the Clerk Administrator's memorandum of <br />2-2-89. Council further concurred to consider an additional Class B License, as <br />suggested by Jim Adams. <br /> <br />Council further directed the Attorney to review the recent North Dakota Law, and <br />the Federal District Court Case in Duluth relative to providing due process for a <br />license renewal and the Attorney General opinion written to the City Attorney in <br />Cloquet relative to regulations that could be included in their City Ordinance. <br />It was also suggested the ordinance recently passed by the City of Anoka be <br />reviewed. <br /> <br />. <br /> <br />STATUS RPT; KEM <br />MILLING <br /> <br />Council was referred to a memorandum from Mayor Sather <br />dated 2-7-89, relative to negotiations for purchase of <br />the Kern Milling facility by the City. <br /> <br />Mayor Sather stated he, Attorney Lynden and Clerk Administrator Berger had met <br />with representatives from Kern Milling to discuss purchase of the rendering plant; <br />details of the proposed offer were outlined in Sather's memorandum. He <br />recommended the City purchase the property with funds from the PIR account and <br />pay back the funds with increments received from the development district. <br /> <br />Berger explained Attorney Lynden had suggested a resolution be drafted, for <br />Council review, which states the City intent to establish the development <br />district to capture future increments, and includes any issues relative to City <br />liability regarding possible contamination and other environmental issues. <br /> <br />Council concurred to direct the Village Attorney and Clerk Administrator to <br />prepare a resolution for review at the next Regular Council meeting held 2/27/89, <br />which specifies the establishment of the development district, include issues <br />related to environmental concerns and generally outlines the terms of purchase of <br />the facility as negotiated. <br /> <br />. <br /> <br />SCHEDULE WORK <br />SESSION; 2/22/89 <br /> <br />Hansen moved, seconded by Malone, that Council schedule <br />a work session to discuss planning issues and review the <br />RFPs for a development consultant on Wednesday, February <br />prior to the meeting with SEH. Motion carried <br /> <br />22, 1989, at 7:00 p.m., <br />unanimously. (4-0) <br />
