SEWER (Cont'd) Raddatz reviewed City records and could not find a plan <br />outlining the pipe installation. He also explained the <br />ditch had been filled and evergreens were planted on top of the pipe. He advised <br />the staff was unable to clear the existing pipe with the jetting truck; when the <br />crew dug up the pipe it was found to be a metal pipe that has corroded. <br /> <br />The Public Works Supervisor requested Council determine the extent of City <br />responsible for repairing the culvert; a neighbor in the area advised the City <br />installed the pipe but could not remember the contractor's name. The Engineer and <br />Raddatz were unable to locate any records which indicate the City installed the <br />culvert. <br /> <br />. <br /> <br />Raddatz stated if Council determined it was the responsibility of the City to <br />repair the culvert, he would recommend a plastic pipe replacement. The cost <br />estimate.. including backhoe rental, would be approximately $6.00 to $8.00 per ft. <br />for replacement of 100 ft. of pipe and $500.00 for the backhoe. <br /> <br />Council questioned if it would be necessary to acquire an easement from the <br />property owners and if there would be any problems with maintenance of the culvert <br />due to the existing trees. <br /> <br />Raddatz advi.sed the homeowners have indicated they would grant an easement and he <br />stated the trees would be affected if the entire pipe was replaced. <br /> <br />Councilmember Winiecki suggested when the easement is drafted it should include <br />City exemption from liability concerning the existing trees if maintenance is <br />necessary. <br /> <br />There was discussion relative to drainage patterns in the area, the method of 4It <br />installing the replacement pipe which could eliminate excessive digging in the <br />area, determining the size of the easement and cost participation by the homeowner. <br /> <br />Council concurred that the City would be responsible for correcting the situation <br />by replacement of the.. pipe . <br />Engineer Peters advised he would determine the size of the easement after the pipe <br />was installed; normal easement are approximately 10 or 15 feet. <br /> <br />Peter Meyers, 1451 Arden Place, indicated he would be agreeable to granting an <br />easement and advised his main concern is the preservation of the evergreens to the <br />extent possible. <br /> <br />Peck moved. seconded by Winiecki, that the Public Works <br />Supervisor and Engineer be instructed to proceed with the project as outlined for <br />Council and that the City Attorney be requested to draft an easement for the <br />entire length of the storm sewer located at 1451 Arden Place, which includes <br />exempting the City from liability relative to the existing evergreen trees planted <br />in the culvert in the event maintenance of the storm sewer is required. Council <br />further determined the costs for drafting the easement would be borne by the City <br />and the costs for review of the easement by an attorney and for obtaining and <br />submitting a "right-of-entry" document would be borne by the Peter Meyers. Motion <br />carried unanimously. (3-0) <br /> <br />4It <br /> <br />COUNTY RD. D; <br />SHOULDER IMPRVMT. <br /> <br />Council was referred to a memorandum from Raddatz dated <br />8-5-88, recommending Council reconsideration of improvement <br />of County Road D by shoulder paving. <br /> <br />Raddatz explained the County has indicated they would defer billing the City for <br />the project costs until January 1989 to allow budgeting of funds. <br /> <br />Steve and Vicki Hinkel, homeowners on County Road D, favored paving the shoulder <br />for safety purposes; it was their opinion the gravel shoulder created a hazardous <br />situation for bike riders and pedestrians in the area. <br /> <br />Councilmembers expressed concern that improvement of the shoulder could create a <br />dangerous situation for pedestrians and bikers by allowing vehicular traffic to <br />utilize the bituminous surface as a traffic lane. <br /> <br />There was extensive Council discussion relative to creating a dangerous situation <br />by improvement of the shoulder and the appearance of the street if the Roseville <br />portion were improved and the Arden Hills portion was not. <br /> <br />. <br /> <br />Peck moved, seconded by Winieck, that Council request <br />Ramsey County complete the shoulder improvement project along County Road D in <br />Arden Hills this year and defer billing the City for payment until January, 1989 to <br />allow Arden Hills to budget the funds for 1989. Motion carried unanimously. (3-0) <br />
