Minutes of the Regular Council Meeting, April 27, <br /> 1987 <br /> Page 5 <br /> Mayor Woodburn and Public Works Supervisor discussed County Road D parking, by <br /> Lake Johanna Park, posting no parking signs early this year before the problems <br /> begin. <br /> CHARITABLE Council was referred to sample Ordinances from various <br /> GAMBL. ORD. communities and the letter from Attorney Lynden <br /> (3-27-87) , relative to enactment of a Charitable <br /> Gambling Ordinance for the Village. <br /> Council discussed if there is a need for an Ordinance, what aspects would be <br /> regulated and guidelines to be given to the Attorney for drafting the <br /> ordinance. <br /> Councilmember Sather noted the State Legislators have rescinded some freedoms <br /> these types of operations are allowed; he asked for items Council proposed for <br /> inclusion in the ordinance. <br /> In discussion, Council cited the following regulatory items for inclusion in <br /> the ordinance: <br /> - Number of Bingo Occasions. <br />. - Number of Charities operating at a singular facility. <br /> - Hours of Operation. <br /> - Phase Out of the operation over a reasonable time period. <br /> - Percentage of return to Community. <br /> - Limiting perimeters of where Charities are located. <br /> Winiecki suggested the Attorney draft an ordinance including all the above and <br /> then Council could discuss each regulatory item at that time. <br /> Attorney Lynden advised he could meet with the Clerk Administrator and draft an <br /> ordinance for Council review which includes the items mentioned above. <br /> SNOWMOBILE ORD. Mayor Woodburn explained he had discussed with the <br /> Attorney the concerns of the Council, relative to all <br /> terrain vehicles operating in the winter months and definition of where these <br /> vehicles could operate. After discussion it was noted that due to the fact the <br /> ground would be frozen and the vehicles would not damage the parkway; Lynden <br /> also defined "roadway" for the Councilmembers. <br /> After discussion, Council consensus was to include the following items and <br /> language in the revised draft of the Snowmobile Ordinance: <br /> 1. Hours of Operation, Sec. 26.42, should be 10:00 a.m. to 8:00 p.m., to <br /> make Ordinance more compatible with neighboring cities. <br /> 2, Equipment should include a Deadman's Throttle, unless covered by State <br /> law, should be included. <br />. 3. Exempting use of these vehicles by governmental agencies in pursuit of <br /> their duties or during emergency use in adverse weather. <br /> 4. Section 26.25(a) Change language to read "An off-road vehicle", rather <br /> than "A three-wheel vehicle. <br /> CONDEMNATION RPT. The Attorney advised that the property owner's attorney <br /> NAEGELE PROPERTY had requested the hearing, scheduled for February, <br /> be postponed; to date the hearing has not been <br /> rescheduled. Lynden also advised he had talked with the <br /> appraiser. the Mayor and the Engineer; the appraiser is willing to reduce the <br /> amount allocated for the temporary easements if the Engineer determines the <br /> length of time for temporary easements retention could be reduced to 6 months <br /> rather than one year. Barry Peters agreed that the City could reduce the time <br /> of the temporary easement to 6 months. <br />. Lynden reported that he wou~d contact the property owner's attorney, by the end <br /> of this week, to discuss the possibility of a settlement of this case, for <br /> review by Council. <br /> ASSMT. LETTER Council was referred to letter from Attorney, dated <br /> 4/27/87, relative to apportionment of assessment for <br /> Council review, as possible assessment policy for the Round Lake project.. <br /> REQ. FOR STREET Council was referred to PS/W Committee meeting minutes <br /> LT. PRIOR/JERROLD (4/16/87) , recommending denial of the request based on <br /> the facts that a light at this junction is not on the <br /> master street lighting plan and the effect of lighting in reducing vandalism <br /> and loitering is questionable, <br />
