The current Property Owner closed the bingo hall and restaurant last fall and did not renew their <br />liquor license for 2024. Today, the Subject Property is being used as an indoor soccer training <br />facility. Both the bingo hall and indoor sports training facility land use are allowed as a <br />permitted use under the definition of Commercial Recreation. This use allows recreational <br />facilities which are operated for profit or render a service which is customarily considered as a <br />business. Of which uses listed in the definition include arcade, arena, art gallery, assembly hall, <br />athletic and health clubs, auditorium, bowling alley, club or lounge, community center, pool or <br />billiard hall, or a variety of organized or franchised sports, including but not limited to <br />basketball, ice hockey, wrestling, soccer, tennis and volleyball. <br />The Applicant intends to purchase the Subject Property upon receipt of the necessary city <br />approvals. An event center does not fall under the definition of a commercial recreational <br />facility or other land use category currently allowed in the city code. Therefore, a text <br />amendment would be needed to add "event center" as either a permitted or conditional use in <br />commercial and/or industrial zoning districts. <br />As a component of the operation of an event center, the Applicant is proposing that they have the <br />option to provide food and liquor at events. Currently, the event center could not pursue a City <br />issued liquor license for two reasons: first, per Minnesota Statute 340A.404 subdivision 1 (c), a <br />City cannot issue a liquor license to an event center in the seven county metro area and second, <br />per City Code (which reflects State Statute), the City can only issue an on -sale liquor license to a <br />business that fits specific criteria, such as a restaurant. <br />There are two options for an event center to provide alcohol at events. The event center could <br />offer properly State licensed caterers that will provide the food with alcohol incidental to the <br />food service. Both of these functions require a permit issued by the State. The second option is <br />the event center would need to qualify as a restaurant and pursue a City liquor license. <br />Attached for basic background information on the State issued licenses/permits is an <br />informational page about the caterer's license for food service (Attachment D) as well as the <br />application from Alcohol and Gambling Enforcement Division for the alcohol component <br />(Attachment E). <br />The Applicant is proposing to utilize State licensed caterers for food and alcohol service during <br />Phase 1 of business operations. In this scenario, the process of licensure and enforcement are <br />administered by the State in conjunction with local law enforcement, per Minnesota Statute <br />340A.404 Subd. 12. Staff has confirmed with the City Attorney that in this scenario the City has <br />no role, and the caterer must comply with all of the State's rules and regulations. Phase 2 of the <br />proposal involves the business having a restaurant within the facility and pursuing a City issued <br />liquor license. <br />Background Concept Plan <br />As part of the proposed redevelopment of the site, the Applicant has provided for the concept <br />review a floor plan, site plan, and rendering for the event center use (Attachment C). <br />Information was not included in the submission on how or where the adult daycare operations <br />would be conducted logistically within the building or for site circulation. Exterior <br />improvements include the addition of a stone base wall and stone front entry with parapet wall as <br />well as outdoor patio areas along the south and east sides of the building. In the B-2 District, a <br />PUD would be required for the redevelopment of this site as proposed.
