Courtney reported that he had received two documents from <br />Mr, James. Atty. for the Vesseys, which would give Arden Hills <br />the sewer "IJasement on Lot 19 and also a drainage 8eseme n'G. <br /> <br />. <br /> <br />Attyo Courtney reminded the Council -that the -two o.thel' easements <br />for snow piling should be obtained as previously determined from <br />the '\l'esseys before the Village owned prope:roty is sold 'GO them. <br />Mr, Vessey info:romed the Council that he has agreed to give the <br />Village -the coZ'ner easement. but he Was not aware of the second <br />easement request although Atty. Courtney stated that the matter <br />had been discussed with him. <br /> <br />Matter referred to Atty~ Courtney to discuss the location of the <br />second easement with Mr. Vessey. <br /> <br />Ordinance' No. 85 Amendment <br />~rustee Lang moved, seconded by Trustee NetheZ'cnt. that an amend- <br />ment to Ordinance No. 85 be introduced by title and given its fiZ'st <br />reading to substitute the 1964 Safety Code for mechanical refBiger~ <br />ation as the standard for meohanical refrigeration systems,emotion <br />carried. <br /> <br />Zoning Matters <br />Continental Oil Co. <br />Atty. Courtney reported that the re~uired papers retarding the <br />Z'equest to rezone from residential to commercial the no~theast coZ'ner <br />of Hwy 96 and 35W to allow the construction of a Conoco Service <br />Station are in confo~ance with Ordinance No. 60. <br /> <br />Trustee Nethercut stated 'Ghat -the Planning Commission l'8commends <br />denial of this request as the area is zoned Nlsidenthl in the <br />Comprehensive Plan. <br /> <br />Matter and material referred to Trustee Nethercut to inform Continental <br />Oil Co" that the Council supports the Planning Con~ission's recorumend2~ <br />tion. but a pUblic hearing would be scheduled if they so desire" <br /> <br />. <br /> <br />Phillips Petroleum Co. <br />'.I!rus 'Gee Nethercut informed the Council th,r t the Planning Commission <br />has not completed its study of the rezoning request for the north- <br />west corner of Hwy. 96 and 8 to permit a Phillips Servlce S.tationo <br /> <br />Atty. J. <br />forward to the Atty. <br /> <br />Area South of F'loral Drive <br />Mayor Kennedy stAted that he is in agreement with Atty, Courtney <br />that action on any rezoning should be a part of the proposed rezoning <br />plan. Trustee Nethercut informed the Cound 1 that the Planning <br />Commission recommends that Public Hearing be ~cheduled ?s soon as <br />possible on the rezoning from ~tl~>Wl to ~.Ai'\3~IiLof the aZ'ea <br />south of Floral Drive and weet-ofHamline Aven'le. <br /> <br />The matter will be discussed further at the joint Council and <br />Planning Commission meeting to be held June 210 <br /> <br />Non~Conforming Signa <br />Clerk Lorraine StromqUist informed the Coureil of an inquiry regard= <br />ing the rebuilding 01' non-conforming signs aftsr they have been <br />blown down. Atty, Courtney Buggeeted that possibly an amendment <br />to the Sign & Billboard Ordinance should be considered; Mayor <br />Kennedy did not think thie necessarYD in his opiniollD such a sign <br />would be rebuilt only if B contract were involved. <br /> <br />Clerk Lorraine Stromquist distributed to the Council copies mX a <br />letter requesting the licensing of a non~conforming sign for a period <br />in excess of the two years which the Clerk is authoZ'ized to allo~o <br />Clerk requested to obt~ln further facts preferably in writing re= <br />garding the cost of the sign. etco <br /> <br />=2= <br />
