FINAL PlAT, relating to the application for Final Plat of <br /> HAZEINUI' PIC #2 Hazelnut Park Addition No.2, Barry O'Meara, North <br /> NO. :KATIE lANE Katie Lane. <br /> The Planner reviewerl the backgroun:l of the application arrl noterl the prelbninary <br /> plat approved in 1.983 arrl the final plat for the first phase of the developnent. <br /> He noterl the first phase of the developnent has to occur within 90 days of final <br /> plat approval. Bergly staterl it is his experience that lTKlSt conununities defer the <br /> staging of plats to the developer; financial and market conditions affect the <br /> timing of the development. <br /> The Planner explained the homes constructed in the area are in the upper <br /> $1.00,000.00 bracket; if homes in a lower range had been constructed, the <br /> developnent of this area may have been accomplished in less time. <br /> Bergly advised the City made some commitments to the developer with the approval <br /> of the plat in 1.983 arrl accepted some park dedication that was donaterl by the <br /> previous ~ of the land, He staterl that C. G. Fein was proposing to develop <br /> townhouses in this area; at the same time Fein was proposing the Arden Plaza <br /> Shopping Center .Bergly explained C,G. Fein dedicaterl 12.37 acres of larrl known <br /> as Hazelnut Park to satisfy the park dedication for two parcels of larrl which <br /> totalerl approxiroately 34 acres. He noterl it appears the park dedication is <br /> satisfierl, however, city staff has not been able to locate d=uments verifying <br /> this matter. <br /> .. Planner Bergly referrerl to a letter from Attorney Filla daterl 1-28-92, relating <br /> to the possible neerl for a public hearing on this plat. Bergly explained the city <br /> Attorney initially was of the opinion that a public hearing would be requirerl <br /> since an extension was not granted to the applicant, The Planner advised that in <br /> recent conversations with Attorney Filla he indicated that if all requirements of <br /> approval have been met and if the park derlication has been satisfierl, a public <br /> hearing would not be necessary, <br /> Bergly stated the applicant developed the first phase of the plat in a=rdance <br /> with all conditions attacherl in the 1983 approval. He noted the applicant has <br /> also revised the second phase of the plat to comply with all conditions <br /> stipulated by the 1983 approval. <br /> The Planner advised a "blanket" 10 foot front setback variance was granterl for <br /> all lots in this development. The 1983 Council action also noted that some lots <br /> in the Katie Court cul-de-sac may require additional variances, although no <br /> specific lots were mentionerl, <br /> Planner Bergly noted the trail derlication 00= on lDt 3, Block 1 of the <br /> preliminary plat has been moverl to Lot 4, Block 1., to more closely align with the <br /> cul-de-sac arrl attach to the existing city trail system. <br /> Bergly reviewerl the variances requirerl as part of the final plat approval of <br /> phase two: <br /> lDt 6: lDt depth variance of 5 ft. <br /> , lDt 7: lDt width variance of 23 feet (at 30 foot front setback line), <br /> Lot 8: lDt width variance of 3 feet (at 30 foot front setback line; meets <br /> lot width requirement at standard 40 foot setback line.) <br />
