He questioned the interest on the part of Zeos representatives to <br /> resolve this matter, based on the fact that six weeks has passed and the sign is <br /> not in compliance with regulations. <br /> The AttoTI1ey representing ZOOS Corporation explainei the =rnpany is interested in <br /> utilizing the sign as a changeable =py sign, as pennitted in the Sign Ordinance. <br /> He advised the definition in the sign Ordinance states, "changeable <br /> =py. . . including t:iJne and temperature", which indicates the definition was <br /> designed to include =py other than t:iJnejterrperate. He =unentei that the intent <br /> may have been to allON oosinesses the opportunity to display messages, which <br /> . change at certain t:iJne intervals. He requested Council =nsider establishing an <br /> acceptable t:iJne period at which the =py nay change. <br /> Malone disagreed with this interpretation. He indicatei it is his belief the <br /> intent of the regulation was only to allON t:iJne and temperature changes <br /> electronically, and that changeable copy signs were the manual type, rather than <br /> electronic. <br /> The AttoTI1ey representing Zoos explained the =npany has received conflicting <br /> info:rnation from the City as to interpreting the definition in the Ordinance; <br /> notei the City issuei a sign pennit for the sign. He statei Zoos representatives <br /> are interestei in resolving this natter. <br /> Acting Mayor Mahowald notei it appears both the City and Zeos understand. there is <br /> a problem and the Sign Ordinance definition nay need clarification. <br /> Council =ncu=ei to direct the Clerk Administrator to contact the League of <br /> cities to determine hON other communities regulate such signs and determine what <br /> is an acceptable t:iJne-frame for copy changes to = on this type of sign. <br /> Council1nernber Hicks notei the Ordinance was draftei by the Plarming Corrrrnission <br /> and suggestei this matter be referrei to Commission f= research and <br /> recommendation. He suggestei city staff review the Commission notes relating to <br /> the discussion when the Sign Ordinance was proposed for adoption. <br /> .
