CITY OF ARDEN HILLS <br /> PLANNING COMMISSION REPORT <br /> TO: Dorothy Person, City Administrator <br /> Arden Hills Ci~ncil <br /> FROM: Brian Fritsinq ~ <br /> DATE: AUgust 18, 1993 <br /> SUBJECT: Recommendation: Case #93-13, Ned , Julie VanHamm, 1448 <br /> Indian Oaks Trail - Front Yard Variance <br /> RECOMMENDATION: The Planning Commission unanimously recommends <br /> approval of a 5 foot front yard variance for 1448 Indian Oaks <br /> Trail. <br /> The consultant/planner had recommended to the Planning Commission <br /> a 2 foot variance to the front yard setback. <br /> BACKGROUND: <br /> . The applicant requested a variance to allow construction of a 6 <br /> foot wide roofed deck or open porch across the main portion of <br /> the house (43.5 feet long). The house is at the end of a cul-de- <br /> sac with the actual setback to the house varying from 38.5' on <br /> the south, 38' at the nearest point and 43' on the north end. <br /> The provision of the ordinance which would apply in this case is <br /> section VI,c,2,a, Permitted Encroachments (to the minimum <br /> requirements). A 3 foot encroachment into a required yard is <br /> allowed for eaves, cantilevered areas, cornices, canopies, <br /> awnings, decks, balconies, steps, ramps, fire escapes and <br /> chimneys, if they are part of the principal structure. The <br /> variance requested would therefore be 5 feet (the difference <br /> between the required setback of 40' and the least actual setback <br /> to the house, minus 6 feet, plus 3 feet for the allowable <br /> encroachment) . <br /> The consultant/planner concluded that none of the lot <br /> configuration conditions required by the ordinance for approval <br /> of a variance were found to exist' on the property. Some of the <br /> issues presented by the applicant (environmental, safety and <br /> reasonableness) are supported by the intent and purpose of the <br /> Zoning Ordinance, however, they do not meet the requirements for <br /> granting a variance. In visiting the site to study the drainage <br /> concern, the staff did not find a situation that reflected a <br /> . great deal of run-off entering the VanHamm property. <br />
