The permit shall specify the restrictions , deems <br />reasonably necessary to protect any person or neiqhborinq use from <br />unsanitary conditions, unreasonable noise or odors or annoyance or <br />to protect the public health and safety. Such permit may be <br />modified from time to time or revoked by the City Health Officer <br />and/or Animal Control Officer for failure to conform to such <br />restrictions, limitations or prohibitions. Such modification or <br />revocation shall be effective from and after ten (10) days <br />followina the mailinq of written notice thereof by certified mail <br />to the person or persons keepina or maintaininq such animals. <br /> <br />~ Outside kennels. An outside kennel must be constructed <br />of open-faced, qalvanized fabric of suitable size to maintain and <br />secure the keepinq of particular breeds of doqs and to allow for <br />sufficient space for particular breeds of doqs to exercise freely. <br />Surface must be constructed of material of either concrete or <br />qravel of sufficient depth to provide for proper cleaninq, <br />drainaqe, maintenance and needs of all particular breeds of doqs. <br /> <br />Jil Refusal to qrant or renew a permit. City Health Officer <br />and/or Animal Control Officer mav refuse a permit to keep or <br />maintain animals hereunder for failure to comply with the <br />provisions of this chapter, if the facilities for the keepinq of <br />the animals are or become inadeauate for their purpose , if the <br />conditions of the permit are not met, if a nuisance condition is <br />. created, or if the public health and safetv would be unreasonable <br />endanaered by the qrantinq of such permit. Refusal to qrant or <br />renew a small kennel license by the City Health Officer and/or <br />Animal Control Officer may be appealed to the City Council. <br /> <br />SECTION 5 - 6 9. APPLICATION AND RENEWAL FEES. The initial <br />application fee for a small kennel license under this decision <br />shall be imposed, set, established and fixed by the City Council, <br />by resolution, from time to time , and the annual renewal fee for <br />any license issued under this division shall ne imposed, set, <br />established and fixed by the City Council, by resolution, from time <br />to time. <br /> <br />SECTION 5-70.
