June Minutes Page 5 06/01/94 <br /> CASE 194-13: CELLULAR ONE - $PECIAL USE PERMIT. 4251 FERNWOOD <br /> AVENUE. <br /> Chair Winiecki opened the public hearing for Cellular One at <br /> 7:38 p.m. Recording Secretary, Tammy Olson, confirmed the <br /> publication of the Notice of Hearing in the Focus on <br /> Tuesday, May 17, 1994, and mailing to affected property <br /> owners on the same date. Chair Winiecki proceeded to <br /> explain the hearing procedures to the attending residents. <br /> Mr. Fritsinger stated there was a lease agreement between <br /> Cellular One and the City to place their antennas on the <br /> Water Tower at Fernwood Avenue. At the time of the recent <br /> five (5) year renewal of this lease, staff suggested the <br /> agreement be formalized through a SUP agreement. Screening <br /> and height are the two main issues. In 1991, the City <br /> Attorney decided the height limitations don't apply to this <br /> type of tower. The antenna itself does meet the ordinance <br /> requirements, although, there is no way to screen the <br /> antennas given their location and height. Staff recommended <br /> . the Planning Commission approve the SUP. <br /> Tedd Olson, of Cellular One, stated in 1989 there was some <br /> discussion between the City and Cellular One. At that time, <br /> there was no need for a SUP. Since then, the City has <br /> updated their Zoning Ordinance and Cellular One wants to be <br /> in compliance. <br /> Hearing no further comments, Chair Winiecki closed the <br /> public hearing at 7:44 p.m. <br /> Piotrowski moved, seconded by McGraw to approve the SUP <br /> with the following conditions outlined in staff's <br /> report: <br /> 1. No additional screening as required by ~he zoning <br /> ordinance shall be necessary. <br /> 2 . The antennas and all mounts shall be painted to <br /> match the color of the.tower. <br /> 3. No welding shall be done on the water tower tank <br /> or shell. <br /> . 4. The antennas shall not exceed 12' in height. <br />
