Mr. Fritsinger has reviewed this with the <br /> City Attorney to evaluate this application under this section of the ordinance because of some <br /> concerns that staff has with Section IX, A, 2. <br /> Mr. Fritsinger reported Mr. Filla did recognize a problem exists with this portion of the <br /> ordinance and suggested that the City try to solve this interpretation problem legislatively. <br /> Mr. Fritsinger indicated the lots in Block 1, Arden Hills Subdivision all have a similar lot width <br /> of 75 feet, however, because of the differences in side yard setbacks, the other homes meet the <br /> required 10 foot setback. <br /> Mr. Fritsinger indicated staff reviewed the potential for expanding the home in the front yard <br /> which would comply with the Zoning Ordinance. The applicants elected not to pursue the <br /> expansion in this direction for a number of reasons of which the most substantial were the loss <br /> of trees and the internal functionability of the home, <br /> Mr. Fritsinger indicated staff recommends approval of the request for a 20 foot side yard variance <br /> ~ for the expansion of the home at 3487 Ridgewood Road based on the following findings: <br /> 1. The expansion does not increase the existing setback encroachment. <br /> 2. The expansion would be permitted on similar sized lots within this district and <br /> neighborhood. <br /> 3. The City has in the past granted variances for corner lots which were developed <br /> prior to the existing zoning standards. <br /> Mr. Erickson, architect for the Lundgrens, indicated the addition would be approximately 1,000 <br /> square feet and would be presenting the smallest portion of the garage to the street. Mr. Erickson <br /> indicated this to be the most logic direction to expand. <br /> Chair Winiecki inquired if this would change the roof line. Mr. Erickson indicated it would not. <br /> Chair Winiecki inquired about the deck, which encroaches on the setback. Mr. Erickson <br /> indicated this to be a pre.existing deck. <br /> Rye inquired if there was any concern for lot coverage. Mr. Fritsinger indicated the ordinance <br /> allows 25% for lot coverage and this would comply with the ordinance. <br /> .. <br /> ------------- <br />
