Staff has reviewed the issues that were discussed at the November 28, 1994, Council <br /> meeting regarding the Bethel College Surface Water Management fee appeal, <br />I After much discussion, staff recommends the following: <br />I- That the total acreage of Lake Valentine be deleted from the quarterly utility fee. The <br /> resultant quarterly S. W.M. fee will be reduced from $9,897.59 to $6,954.24. This is a <br /> 29,7% reduction, Staff also recommends that the reduction be retroactive to April 1, <br /> 1994. As indicated in the enclosed letter, Bethel College notified staff in March of 1994 <br />I of their intent to appeal the S. W.M. fee. The April I , 1994 retroactive date is the start of <br /> the second quarter billing period for 1994, If Council agrees with this recommendation, <br /> Bethel College will be reimbursed for the second and third quarter fee adjustments. As <br />I directed by Council at the December 28, 1994 Council meeting, the reduced S. W.M. fee <br /> was assessed to Bethel College for the fourth quarter of 1994, <br />I That there be no change to the current zoning for Bethel College, Staff believes that there <br /> are no warrants to change zoning at this time. <br />I Also enclosed in the Council packet is a letter from Mr. James Unruh P,E., who is the <br /> Bethel College consulting engineer on this issue. The letter is the response to the issues <br />I that were discussed at the November 28, 1994 Council meeting. A letter from City <br /> Engineer Greg Stonehouse is also enclosed reviewing his opinions for this appeal. <br />I <br />I <br />I- <br />I <br />
