City Attorney Filla <br /> indicated a condition could state; Association bylaws to include the following term and to be <br /> I reviewed before final City approval. <br /> Nelson indicated he would like to amend the motion with the two following conditions added: <br /> I 4. Association bylaws to include the term of no additional garages to the site, and be <br /> I reviewed by City Attorney before final City approval. <br /> 5. The public easement is to be clearly identified, and any necessary site plan <br /> I adjustments made. <br /> Nelson moved, Larson seconded a motion to accept amendment to motion adding <br /> I conditions 4 and 5 to Case #95-5. <br /> Rye indicated this procedure of Planned Unit Development is the lesser of two evils. He <br /> I indicated the City would have more control over the type of project to be developed, and less <br /> effect on the open space. <br /> I~ Mr. Fritsinger indicated clarification of condition number three, if the location of an oak would <br /> be in the proposed roadway. Larson indicated he had no objection to the removal of a tree in the <br /> roadway, but merely was concerned with the North side of the property. <br /> I Chair Erickson indicated condition three would then read: <br /> I 3. No oak tree will be removed unless noted in a building footprint or roadway area. <br /> I Motion carried. (5-1 Commissioner Piotrowski voting nay). <br /> Residents voiced various questions. <br /> I Mr. Fritsinger indicated in reply to questions regarding wetland. He indicated this site is not to <br /> his knowledge recognized as a wetland or floodplain under review of the Department of Natural <br /> I Resources and the Rice Creek Watershed district. However, these agencies are still reviewing the <br /> proposed development.
