COMPREHENSIVE PLAN AMENDMENT FOR I
PROPERTY ON THE NW CORNER OF COUNTY ROAD E2 AND OLD HIGHW A Y I
lQ.
Mr. Bergly indicated the City staff requested the Comprehensive Plan be amended to clarify the
designation of a 6.5 care parcel at the NW corner of County Road E2 and Old Highway 10. The I
parcel is currently designated as a Park and Open space use on the land Use Plan map and on the
Comprehensive Development Plan Map, but is not designated as a Park and Open Space use on
the Park and Open Space Plan map. I
Mr. Bergly indicated the inconsistency should be resolved by changing the Land Use Plan and
Comprehensive Development Plan designation to a Low Density Residential category. I
Mr. Bergly indicated this needs to be corrected whether this parcel is under other issues or not.
Chair Erickson inquired if there are other areas that can be identified as inconsistent and I
corrected. Mr. Fritsinger indicated the Comprehensive Plan has not been reviewed as of yet. I
Mr. Bergly indicated some changes have been made to the Comprehensive Plan, but not all the
changes have been made physically on the maps. -I
Chair Erickson opened the public hearing at 11:04 p.m.
Mr. Jim Summerfeld 1710 Glenview Avenue, asked in order for this to occur, isn't there a I
super majority (4/5) required by the City CounciL Mr. Fritsinger indicated a 2/3 vote or in this
case a 4/5 vote to be correct. I
Mr. Summerfeld indicated he had encouraged residents to send letters to the City Council, to
inform them of public opinion. I
Chair Erickson hearing no further comments closed the public hearing at 11:08 p.m.
City Attorney Filla indicated earlier he noted the Zoning Ordinance prevails over the I
Comprehensive Plan. He indicated in theory after the Comprehensive Plan is adopted, the I
Zoning Ordinance is developed and adopted. The Comprehensive Plan is not as specific as the
Zoning Ordinance and therefore takes precedent.
Nelson moved, and Carlson seconded, a motion to approve Case #95-12, Comprehensive I
Plan Amendment for Property on the NW Corner of County Road E2. The motion
carried unanimously (6-0). I
-.
I
