He indicated parking and open space requirements are the same as Parcel A after I <br /> division as on the total Control Data parcel before division and will be addressed for Parcel B <br /> development in the Site Plan Review. <br /> Mr. Bergly indicated the second stage development will provide a plat which includes street and park I <br /> dedication. Due to the involvement of Control Data with the Parcel A street dedication/park <br /> dedication; the division of Parcel B; and the related issues of parking and open space, a POO may be I <br /> an appropriate procedure for the second stage. <br /> Mr. Bergly presented the Planning Commission with a revised set of recommendations. I <br /> Commissioner Carlson indicated condition number seven, would it be a binding agreement and the I <br /> applicant would be bound by the park dedication. Mr. Bergly stated that was the intent of the City <br /> Attorney, to have both the applicant and the City aware of the agreement and that all conditions <br /> would be adhered to during development. I <br /> Commissioner Nelson inquired in regards to access to Cummings Park and the proposed parking lot <br /> in the second stage. Mr. Fritsinger indicated the City has in the past used Control Data parking lot . I <br /> for access to Cummings Park and now currently has a lease agreement through December 31, 1995. <br /> He noted the Parks and Recreation Department has not yet discussed options regarding access and <br /> parking for Cummings Park. I <br /> Commissioner Larson inquired if the site as part of the second stage development will meet parking <br /> and landscaping requirements. Mr. Bergly indicated although it is not identified, the requirements I <br /> will be met in the second stage also. <br /> Commissioner Larson inquired if when the applicant presents the POO, it will include all the I <br /> properties, including all of Parcel B. Mr. Bergly stated that was correct and it is the City's intent to <br /> have the POO consist of all three parties. This will create a multi-use for multiple buildings on one <br /> site. I <br /> Commissioner Larson asked, if by giving the December 31, 1995 deadline, this was giving the <br /> authority to build the second stage without requirements. Mr. Bergly indicated there were certain I <br /> issues that could not be resolved in one month, so the applicant was given a reasonable time frame <br /> for completion of the total project. He noted the City felt they could approve the first stage if they I <br /> had control over the second stage. <br /> Mr. Fritsinger, in response to previous discussion of park dedication for point of clarification, I <br /> indicated the Planning Commission does not take action on Park Dedication that is left for the City <br /> Council negotiates that aspect of the dedication. . <br /> I <br /> I <br />
