Mr. Sikora indicated they have researched <br /> alternate locations and still feel this location is the most appropriate. Discussion was held regarding <br /> the location of the pond, with various options explored. <br /> I Chair Erickson inquired as to the status of the application with Rice Creek Watershed District. Mr. <br /> Sikora indicated they are awaiting the Planning Commission's decision and then will make their <br /> I decision and forward it to the City Council. <br /> Commissioner Sand inquired as to when the pond is to be constructed. Mr. Sikora indicated this <br /> I would be required to be constructed by the Rice Creek Watershed District during the first stage of <br /> development. <br /> I Commissioner Larson asked if an easement was established with Control Data, could the area north <br /> of the park be used for the pond. Mr. Sikora indicated if an easement was requested, the landowners <br /> . would most likely require him to buy it. Commissioner Rye noted the pond could also benefit Control <br /> I Data. Mr. Sikora stated Control Data is not required to pond their site at this time. <br /> Commissioner Sand questioned when the second stage of construction will begin. Mr. Sikora <br /> I indicated it would depend on various issues. <br /> I Commissioner Sand asked if the landscaping is done in stage one, why is the applicant given until <br /> December 31 to finish the site plan. Mr. Bergly indicated the City felt this was reasonable time to <br /> resolve any outstanding issues. <br /> I Commissioner Sand inquired about open space. Mr. Fritsinger indicated the amount of open space <br /> is referring to 35% total overall green space. He indicated these type of issues will be addressed in <br /> I the PUD. Mr. Bergly added the landscape area is also referred to as open space. <br /> Discussion continued on the location of the pond area. <br /> I Chair Erickson asked if the applicant CSM was agreeable to the revised recommendations of staff <br /> Mr. Sikora indicated the applicant is in agreement. <br /> I Chair Erickson inquired if Control Data was still comfortable with leased access to the park for the <br /> year. Mr. Jim Bellandi indicated he did not foresee any problems, but to clarifY, he stated any PUD <br /> I in the future will have to be negotiated. <br /> I . <br /> I <br />
