Mr. Bergly indicated <br /> I the parking will be well within the required amount. <br /> Chair Erickson requested review of the issue of access, the driveway versus the collector street. Mr. <br /> I Berg1y noted various business's use this option. Mr. Bergly noted it would actually be an ideal <br /> situation for the location, and the City will not maintain this private road or driveway. <br /> I ConunissionerRye asked if the Public Works and Safety Board should be aware of this application. <br /> Mr. Fritsinger indicated, typically an application would not go before them, but it could be reviewed <br /> by them, ifit is the desire of the Planning Commission. <br /> I Commissioner Nelson inquired as to the reasoning for not fencing around the pond. Mr. Sikora <br /> indicated the fencing is only to protect the area from pedestrian traffic. <br /> I Commissioner Sand inquired if fencing was added, how far would it be from the curb. Mr Bergly <br /> . indicated it would be located behind the utility right-of-way line, approximately five feet. <br /> I <br /> Conunissioner Sand inquired ifthere is any limit. Mr. Fritsinger indicated the fence can be put up to <br /> the property line, but doesn't address public right-of-ways. <br /> I Conunissioner Nelson asked if the applicant would put up a fence. Mr. Sikora indicated the applicant <br /> I would prefer not to put a fence up, but is still negotiating with Rice Creek Watershed District <br /> regarding this issue. <br /> . Chair Erickson inquired if there is a regulation for fencing of ponds over a certain depth. Mr. <br /> Fritsinger indicated this is not addressed in the Ordinance. <br /> . Mr. Bergly indicated the slope is also an issue regarding the pond, and the Rice Creek Watershed <br /> District does not have requirements, just guidelines regarding this. <br /> I Commissioner Sand inquired how erosion will be controlled. Mr. Sikora indicated sod will be <br /> planted. <br /> . Commissioner Sand inquired if this application will come before the Commission again. Chair <br /> Erickson indicated not until the PUD review. <br /> I Conunissioner Sand inquired how the fence issue would be resolved. Mr. Bergly indicated it could <br /> be resolved at the staff leveL Conunissioner Nelson suggested a condition could be added to specify <br /> .- a six foot fence requiremenr. <br /> I <br />
