Walsh, Parks & Recreation Director <br /> SUBJECT: Sheehy Property Tennis Court Use <br />. <br /> Homeowners Association Request to use the Court <br />. In a previous memo, 1 outlined a request by the Arden Hills #3 Homeowners Association to <br /> maintain and use the tennis court located on the former Sheehy property <br />. The association is interested in entering into some type of agreement that would allow them to <br /> maintain the court and then have it be accessible only for association member use They are also <br /> interested in what the City would do with the property in the future and how that future <br />. development would impact their improvements to the court. <br />.. Possible Ootions <br /> The possibility of leasing the tennis court area to the Homeowners Association has been discussed <br /> with Attorney Filla. He confirmed that the City could be protected from potential liability by <br /> drafting us a lease to ensure that Arden Hills would not be responsible for maintenance or any <br />. injuries that may occur within the court area. <br /> While staff is supportive of the leasing concept, I am concerned about turning a publicly owned - <br />. area into a privately used facility. If the homeowners association maintains the court, they want <br /> exclusive use of it. <br />. There will be representatives from the homeowners association present at the worksession to <br /> discuss possible options.
