Chapter 11 — Subdivisions and Chapter 13 — Zoning Code and the District Provisions in Section <br />1320. The Preliminary Plat is the first step toward the Final Plat, which is required for the <br />development plans for this property. If the Preliminary Plat is approved, the Final Plat will be <br />brought forward in a later land use application for review and evaluated according to the <br />Subdivisions ordinance. <br />2. Rezoning <br />The Applicant is requesting to rezone the 10.74 acre Lot 2, Block 1 parcel from B-1 Limited <br />Business District to R-4 Multiple Dwelling District to be consistent with the site's guiding as High <br />Density Residential in the 2040 Arden Hills Comprehensive Plan. The rezoning would also <br />provide for the Applicant's intended use for the parcel as an age -restricted (55+) active senior <br />apartment community with a single three-story building. The evaluation of the proposal is based <br />on the requirements of Chapter 13 — Zoning Code, the District Provisions in Section 1320, and <br />consistency with the adopted Comprehensive Plan. The City Council's review of this rezoning <br />request should also consider the following: <br />1. Conformity with Comprehensive Plan <br />2. Substantive changes that have occurred making the zoning change necessary <br />3. Demonstration showing that the change is superior to the current Zoning and/or <br />Comprehensive Plan <br />4. Development conditions or priorities that make the existing Zoning and/or Comprehensive <br />Plan impractical <br />Findings of Fact <br />The Planning Commission reviewed this application at their August 7, 2024 meeting and have <br />offered the following findings of fact for the City Council's consideration: <br />1. The Subject Property at 1700 West Highway 96 is located in the B-1 — Limited Business <br />District and R-1 — Single Family Residential Zoning District. <br />2. The Arden Hills 2040 Comprehensive Plan designates future land use for the Subject <br />Property as HDR, High Density Residential and as P/I, Public and Institutional. <br />3. The Applicant has submitted a land use application for a preliminary plat to subdivide the <br />Subject Property into two (2) lots. <br />4. The proposed subdivided lots would meet the size requirements for lots in their designated <br />zoning classification. <br />5. The Applicant's land use application includes a request to rezone the proposed 10.74-acre <br />northwest parcel from B-1 —Limited Business District to R-4—Multiple Dwelling District. <br />6. The proposed 10.74-acre parcel would meet the size requirements for lots in the R-4 Zoning <br />District. <br />7. The 30 +/- acres of developed land on the Subject Property would remain as R-1 — Single <br />Family Residential. <br />8. The rezoning of the 10.74-acre parcel would resolve a conflict between the <br />Comprehensive Plan and the zoning ordinance. <br />9. Rezonings require a public hearing prior to action by the City Council. <br />10.
