Options and Motion Language <br />The Planning Commission reviewed this application at their August 7, 2024 meeting. At that time, <br />they recommended approval of the application for a Preliminary Plat and Rezoning by a 6-1 vote. <br />The following are motion language options for the City Council to consider. <br />Approval with Conditions: Motion to approve Resolution 2024-041 and for Planning Case <br />24-015 for aPreliminary Plat and Rezoning for the 10.74 acre parcel at 1700 West Highway <br />96, based on the findings of fact and the submitted plans, as amended by the conditions in <br />the August 26, 2024 Report to the City Council: <br />1. The Applicant shall submit to the City a land use application for Final Plat within <br />three (3) months after the date of approval of the Preliminary Plat. <br />2. The Applicant shall work with the Rice Creek Watershed District to review future <br />modifications to vacate existing drainage and utility easements as well as proposed <br />newly dedicated drainage and utility easements prior to submittal of the Final Plat <br />application. Modifications and newly dedicated easements shall be to the satisfaction <br />of RCWD and the City. <br />Approval as Submitted: Motion to approve Resolution 2024-041 and for Planning Case <br />24-015 for aPreliminary Plat and Rezoning forthe 10.74 acre parcel at 1700 West Highway <br />96, based on the findings of fact and the submitted materials. <br />Denial: Motion to deny Planning Case 24-015 for a Preliminary Plat and Rezoning for the <br />parcel at 1700 West Highway 96, based on the following findings: findings to deny should <br />specifically reference the reasons for denial and why those reasons cannot be mitigated. <br />• Table: Motion to table Planning Case 24-015 for a Preliminary Plat and Rezoning for the <br />parcel at 1700 West Highway 96: a specific reason and information request should be <br />included with a motion to table. <br />Deadline for Agency Actions <br />The City of Arden Hills received the completed application for this request on July 17, 2024. <br />Pursuant to Minnesota State Statute, the City must act on this request by September 14, 2024 (60 <br />days), unless the City provides the petitioner with written reasons for an additional 60-day review <br />period.
