..

.

19

.

lei?. SH:)RT: Your land is not platted into a platted lot.
It's a building site and you would have to pay frontage
which would be comensurate with the benefit you received from the
sewer. I'~ taling sort of law-like here when I say that assessing
has to be done on the basis of benefit to the property. If there
isn't benefit there can't be assessment but if you have ade4uate
property and benefit for more than one reason beside a building
site. then your benefit is greater than that on a small building
site. I can't tell you exactly what the assessment would be
but as far as immediate assessment is concerned, you would be
assessed the same as platted property for that portion of your
property that gets benefit from the sewer.
I~. DOEPNER: As I see here, this 8 inch main seems - you
say you come down to the low spot of the saddle so my house will
be probably I would say from that point probably laC feet from
the termination of the main.
MR. SHORT: AS you know, you have a number of terraces on
your property between the home and the lake and because of those
terraces and the location and trees we didn't feel it was proper
that the village should undertake to construct through the terraces
and damage them and have to pay for the damage but the sewer should
come on to your property so you could reasonably connect to it rather
than building it up to your house.
I~. DOEPNER: Then th4e terraces are really in front of my
house.
MR. SHORT: Extending north and south.
~fl. DOEPNEH: And the main here seems to end at the low part
of the saddle so that part of the property which is north of this

.

.
