<br />Attorney Courtney reported that he had talked with Mr. Welk from the
<br />N. S. P. Company concerning the rlght-of-wa1 for the trail and hss
<br />an appointment with a representative of N. S. P. for negotiations for
<br />this right-o'-way.

<br />Attorney Courtney has consulted with Standard 011 Company concerning
<br />the 50' easement to provide for a future service road.aAQ tAS) BFa

<br />Courtney to draft a 50' easement from Standard Oi I Company to the
<br />Vii lage stating that this wou:d be used for roadway and utility pur-
<br />poses; this 6asement could be used by Standard 011 Company for parking,
<br />etc. until such time as the road Is constructed. There will be no
<br />commitment from the Village on the time limitation.

<br />Pr~posed Zoninq Ordinance Matters
<br />Countv Road D and NGW Bri9hton Ro~ - Trustee Hollenhorst In-
<br />formed tho Council that a letter written by him to the Village Rose-
<br />vii Ie requestfng their zoning plans for the Roseyille area located
<br />south of County Road D had been referred to the Rosev! I Ie Planning
<br />Commission. Mr. Brodie st~teo that Carl Dale is also discussing this
<br />matter with Rosevi I Ie.
<br />The Counci I determined that the zoning of this area would remain as
<br />proposed.

<br />Permitted Uses
<br />Trustee Bjorndahl moved. seconded by Trustee Hollcnhorst, that the
<br />language on Page 2, paragraph E, at'tar the caption be amended to read
<br />0;; follows:
<br />"Except as provided herein, and subject to special use
<br />provisions In Paragraph F re Special USGS, no burldlng
<br />or premises may bA devoted to uses other than those Indicated."

<br />Attorney Courtney stated that he sees no legal objection to changing

<br />Furniture Company and south of the 500 Line tracks; Mr. Dale also

<br />contact the owners of the property for their preference.

<br />An excerpt from a letter, dated January II, 1965, from
<br />Atty. Courtney concerning drive Ins was sent to members
<br />of the Counci I. Mr. Dale recommended In his letter,
<br />dated January 24, 1967, that drive ins be allowed by
<br />special use permit only; Atty. Courtney agreed with the
<br />recommendation, but questions whether naming only two
<br />types of drive Ins as eligible for a special use permit
<br />is valid from a legal standpoint. He believes we must
<br />write in the exception to service stations and also
<br />believes the most objectionable type of establ ishment would
<br />be the type that would deal with food and beverages. There
<br />was much discussion on this subject.
