He also talked with N.S.P. Co. reflardlnfl the three Utility Easements referred to In Atty. Courtney's letter. N.S.P. explained to him that the 1959 easement was an option that was not exercised by N,S.P., the 1942 easement ~ was also not belnfl used by N.S.P. The third easement extends across a corner of the plat for a transmission line, which Mr. Georfll has added to the plat, submitted to Attorney Courtney. Attorney Courtney advised that Mr. Johnson obtain a release from N,S.P, for the 1942 and 1959 utility. easements, one of whiCh Includes a provision for a push brace whiCh Is not shown on the amended plat. He further advised that Mr. Georgi clarify the descrlptl~ns of the Highway Dept. takings for concurrence In language. Because of the time element Involved, and the urgency of potential purchasers to construct basements for two homes In th I s P I at before frost, Mr. Johnson requested that the matter be expedited If possible. It was moved by Councilman Henderson and seconded by Councilman Olmen that Council approve the amended plat authorizing It to be signed by Mayor and Clerk as approved by the Planning Commission at a special meetln g to be scheduled after the amended plat Is submitted by Mr. Johnson. (Several copies to be submitted). The amended plat should Include the above clarification requlr~ents; motion carrIed. The Clerk was requested to forward the executed copies of the plat to Attorney Courtney for final review. Mr. Johnson was advised that after this has been accomplished, he then must file the approved plat with the Ramsey County Plat Commission for approval. REPORT OF COUNCILMAN E. Engineer Lund reported that the 'ot on the north side of Ingerson Road, across from Ingerson Court, appears to be a buildable lot. . The Village has the first chance at ownership on tax-forfleted pr~erty, If It deslr~ to exercise Its option, but the previous owner has Indicated that he would like to have the property back. Engineer Lund advised that the CouncIl had been polled re proceedlnll with this possible change order, because the contractor was working In the Immediate vaclnity. The Change-order has been prepared and maIled to the VIllaQe offIce. He advised that the orlQlnal cost was estimated at t7,OOO:00 but the actual cost of $5,852 resulted because of 200 feet less construction required.
