Bjorndahi presented a petition from residents on Shorewood <br />Drive requesting water service to their area. (Included In 68-11 <br />Clerk L. Stromquist was requested to Inform the County of the pro- <br />posed water Improvement through the Ramsey County owned property along <br />Lake Johanna Boulevard. , .~ <br /> <br />1t was moved by H. Crepeau and seconded by S. Olmen to approve the~ <br />Kresolutlon setting the date for the public hearing for Water Improve- <br />ment 68-1 on March 19, 1968, at 8:00 p.m., In the Lake Johanna Elemen- <br />tary School; motion carried. <br /> <br />REPORT OF COUNCILMAN JOHN HOLLENHORST <br /> <br />Elevated Water Tank <br />Councilman J. Hollenhorst reported that the Planning Commission had <br />Indicated a preference for the hydro-pillar type water tank, but after <br />being advised this type was only manufactured by one company, the <br />members recommended the pedestal Spheroid type so that competitive <br />bids could be submitted. <br /> <br />Engineer N. Hendrickson was requested to write the bid specifications <br />for the pedestal spheroid type of tank with alternate specifications <br />for the hydro-pillar type. <br /> <br />Kostohryz Variance - Case No. 67-23 <br />Councilman Hollenhorst advised the Council that an agreement has not <br />been reached between Mr. Kostohryz and Dr. Blomquist In regard to the <br />lot to the north of the Blomquist property and to the south of the <br />proposed building site of Mr. Kostohryz. He advised that Mr. Kostohryz <br />now has offered to submit a set of restrictive covenants for this lot, <br />to prevent future setback variance requests for this lot. <br /> <br />Mr. Gerald Frisch, attorney for Mr. Kostohryz, explained these covenants <br />would benefit all the property owners In Lot 5, Arden Hills, and would <br />be a private agreement among the property owners of Block 5. <br /> <br />Dr. Blomquist, 3521 North SnellIng Avenue, stated that the esthetic <br />appearance of the proposed varIance request stili prevails, and the <br />homes built along the street previously, were built with confidence <br />that the Village Ordinance would be adhered to. He requested that he <br />be given a copy of the restrictive covenants proposed to be placed on <br />this lot by Mr. Kostohryz so his attorney might review them. He also <br />stated that It Is difficult for him to see that thIs agreement would <br />be more restrictive and/or more binding than the Village ordinances. <br />He said that basically his desire Is that a buffer zone between his <br />property and that of the Kostohryz building site be established to <br />minimize the extensive variance requested by Mr. Kostohryz. <br /> <br />Attorney Frisch requested that the Council approve the variance request <br />subject to the epproval by Attorney Courtney of the restrictive coven- <br />ants to be submitted for the lot to the south of the Kostohryz building <br />sIte. <br /> <br />Mayor Bjorndahl advised Mr. Frisch that the variance request Is exten- <br />sive and the Council will want to discuss the matter with Attorney <br />Courtney and be on firm ground before considering the granting of a <br />variance of this extent. He stated that the Council also has an obli- <br />gation to protect property owners who have built In the area previously. <br /> <br />Attorney Frisch was requested to prepare the restrictive covenants <br />he proposes and submit them to Attorney Courtney with a copy to Dr. <br />Blomquist and a copy to the Council for consideration. <br /> <br />Dr. Blomquist stated that his original objection Is stili pertinent, <br />and he stated that even though Council had requested Mr. Kostohryz <br />to submit alternate plans, only one plan has been submitted. <br /> <br />Mr5.Alvln Faltelsek, 3515 North Snelling, asked if the restrictive <br />covenants proposed would affect other lots In Block 5. Mr. Frisch <br />explained that they would not. <br /> <br />-2- <br />
