A Site Plan Review is required by the City Code for any Planned Unit Development Amendment. <br />Since the Planning Commission review, the Applicant has submitted updated site and landscaping <br />plans approved as part of Planning Case 24-014. From the PUD approval, there are minor changes <br />to the proposed site plan with curbing and parking island configurations and the landscaping plan <br />has differing plant species. Resolution 2024-038 requires that any significant changes be approved <br />by the Planning Commission and City Council, and the proposed changes to the site submitted on <br />October 16, 2024, were deemed to be minor. These proposed minor changes are still under review <br />by city staff and will be considered for approval as part of future permit reviews. No additional <br />changes to the layout of the site are proposed with this application. <br />This commercial corridor is accessible by way of County Road E West. This area is used by several <br />businesses for a variety of retail, manufacturing, distribution, warehousing, and office uses. <br />2. History of the Subject Property <br />The Subject Property was developed in 1986 as a bingo hall consisting of the approximately 11,000 <br />square foot principal structure. A site plan review was required for this development as the property <br />had previously been used as a lumber site. The property changed ownership in 1991 and 2020 with <br />its continued use as a bingo hall which falls under the Commercial Recreation, Indoor land use <br />definition in the City's Zoning Code. In 2020, the property's kitchen was remodeled and the <br />Brightside Cafe was opened within the existing bingo hall. In 2021, the Brightside Cafe was <br />approved for a liquor license effective in 2022. In 2023, Northern Lights Bingo Hall ceased bingo <br />game operations and the Subject Property started to be used for organized sports, which also falls <br />under the definition of a Commercial Recreation, Indoor land use with the installation of turf for <br />the rental use of soccer clubs for practices. A liquor license for the Brightside Cafe was maintained <br />through the end of 2023 but was not renewed for 2024. <br />Approvals <br />1. Planned Unit Development Amendment <br />The site currently has a PUD that was approved with Resolution 2024-038. This PUD allowed for <br />flexibility on the site and approved the event center and restaurant uses. The flexibilities approved <br />with the PUD include: <br />• Flexibility from off-street parking setbacks <br />• Flexibility from exterior building materials requirements to allow for brick veneer instead <br />of brick <br />• Flexibility from the required 75% desirable materials for the south building elevation <br />• Flexibility from the transparency standard that requires 50% of all first level building <br />fagades that front a public street shall be comprised of transparent windows or doors due <br />to the construction of the existing building and the nature of the proposed use <br />• Flexibility for lighting that exceeds 1 foot candle on the travel lanes of adjoining public <br />streets <br />• Flexibility from the requirement of restaurants to provide functional outdoor seating areas <br />with tables, chairs, plantings and access to the restaurant <br />• Flexibility from the planting islands requirements for one tree per parking lot planting <br />island <br />Page 3 of 10 <br />
