Conditional Use Permit <br /> <br />A “Dwelling: multiple family” (multiple family dwelling) is a conditional use in the R-4 Multiple <br />Dwelling District. Typical factors to consider in the evaluation of the CUP request may be hours <br />of operation, potential noise from the proposed use, lights from vehicles, and on-site traffic. The <br />Applicant is proposing all events will be held inside the building to contain noise within the venue <br />and their request includes supplementary materials related to a security plan and traffic <br />considerations. <br /> <br />City Code Section 1355.04 Subd. 3 of the Arden Hills Zoning Code lists the criteria for evaluating <br />a CUP. The Planning Commission and City Council should consider the effect of the proposed use <br />upon the health, safety, convenience and general welfare of the owners and occupants of the <br />surrounding land and the community, in general, including but not limited to the following factors: <br /> <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and <br />other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; <br />6. Adjoining land values; <br />7. Park dedications where applicable; <br />8. Orderly development of the neighborhood and the City within the general purpose and <br />intent of the Zoning Code and the Comprehensive Development Plan for the City. <br /> <br />City Code Section 1325.045 Multi-family Dwelling Units Additional Conditional Use Permit <br />Criteria establishes eight additional criteria to consider for a multi-family dwelling unit CUP. A <br />full evaluation of these criteria will be reviewed later in the staff report. <br /> <br />3. Site Plan Review <br />A site plan review is required for new development or additions in any business, industrial or <br />multiple family zoning districts, for PUDs, and CUPs. <br /> <br />4. Final Plat <br />A Final Plat is required to subdivide property. On September 11, 2024, the City Council approved <br />a Preliminary Plat for the property. <br /> <br />5. Easement Vacation <br />Drainage and utility easements exist on the Subject Property that the Applicant is proposing to <br />vacate the delineation of existing easement boundaries and dedicate new easements as part of the <br />final plat. The vacation and new dedication of easements has been discussed with the City <br />Engineer/Public Works Director and has no additional comments. Rice Creek Watershed District <br />has also reviewed and has no additional comments with the easements as presented. <br />
