The Councl I agreed that the problem must be solved and requested that citizens direct letters to the Ramsey County Board and to the Rice Creek Watershed DistrIct, and said that the Village Council will con- tinue Its efforts to resolve tho problem. REPORT Of VILLAGE ATTORNEY JAMES LYNDEN Uniform FranchIse Ordinance - Ordinance No. 172 . Attorney Lynden explained there is no latitude to change the terms of the Ordinance and recommended Counci I adoption of the Ordinance as presented, except to chango the heading to conform with the stand- ard form tor Arden Hills ordInances. Crichton moved, seconded by Hollenhorst, that the rules be waived and the Council adopt AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A MINNESOTA CORPORATION, iTS SUCCESSORS AND ASSIGNS, P~RMIS- SION TO CONSTRUCT, OPERATE, RE~AIR, AND MAiNTAIN. IN tHE VILLAGE Of ARDEN HILLS, MINNESOTA~ AN ELECTRIC DISTRIBUTION SYSTEM AND TRANSMIS- sl6N LINES, INCLUDING ECESSARY POLES POLE LINES, AND FIXTURES AND APPURHNANCES: FOR THE FURNISHING OF hECTRIC ENERGY TO THE VILLAGE AND ITS INHABlTANTS6 AND OTHERS, AND TO USE THE STREETS, ALLEYS. PUBLIC WAYS AND PUBLIC GRO NOS OF SAID VILLAGE FOR SUCH PURPOSES; PRESCRIBING CERTAIN TERMS AND CONDITIONS THEREOf, AND PRESCRIBING THE RATES TO BE CHARGED THEREF~, as modified in the title; motion carried unanimously. Hollenhorst moved, seconded by Horrlck, that the Councl I adopt Resolu- tion No. 72-23: RESOLUTION AUTHORIZING THE VILLAGE!S MEMB RSHIP IN THE METRO RATE AUTHORITY, DIRECTING ITS OF I ER TO EXECUTE AND DELIVER THE JOINT AND COOPERATIVE AGREEMENT! AND DESIGNATING ITS REPRESENTATIVE TO THE BOARD OF DIRECTORS OF THE ME RO RATE AUTHORIty; motion carried unanimOUSly. . - Hlghw~y E~sement Attorney Lynden reviewed his latter of May 25, 1973, re S.T.H. 51-125, Highway Easement. In which he advIsed that the Highway Oepa~tment Intends to retain the highway easement; however, they may be amenable to the Village's using the rlght-ot-way for open space or park purposes on some type of lease or license basis until the Highway Department makes a determInation to use the right-of-way or to relinquish It. The Council refsrred the m~tter to the Parks and Recreation Committee for its recommendations to the Council. REPORT OF VILLAGE ENr,INEER DON LUND . County Road E - Water Break Engineer Lund described the proposed County Road Erepair work and said he wll! have estimates tor the work at the next Council meeting. The Council authorIzed Engineer Lund to proceed Immediately with the repairs. if the estimated cost of final repair Is expected to exceed $5,000, Lund was requested to proceed with temporary repairs until bids can be obtained for the permanent repair; Council to be pollad when Engineer obtains a contractor. -2-
