<br />Minutes 01- Regular Council Meeting <br />Page two <br /> <br />June 30,1975 <br /> <br />discussed the requirement of a shared parking agreement with Mr. <br />Carroll and Roberts Properties: apparently there would be no problem <br />In obtaining a legal instrument while Weber Cabinet occupied premises <br />Involved In shared parking. Olscussion followed concerning need for <br />a perpetual easement and difficulty of securing this from Roberts <br />Propert i es. <br /> <br />McGough stated that Council has previously approved the parking <br />variance; a perpetual easement for shared parking would seem Impossible <br />to obtain; Carroll Furniture does not need, nor anticipates the need <br />of additional parking: wi II not build on an interim basis; requirement <br />of this document at this time appears contrary to previous action <br />by Council. <br /> <br />. <br /> <br />After discussion, Woodburn moved, seconded by Feyerelsen, that Council <br />approve the Issuance of the Building Permit for Carroll's Fine <br />Furniture's addition In accordance with plans received 6/3/75. Mot~on <br />carried (Woodburn, Feyerelsen, Wingert, Crepeau voting In favor of the <br />motion; Crichton abstaining). <br /> <br />Case No, <br />A. <br /> <br />74-14, Pemtom, Inc. <br />Public Pathway Easement <br />Lynden referred Council to his letter of 6/30/75 and attached <br />Easement Agreement, <br /> <br />Feyerelsen moved, seconded by CriChton, that Council approve <br />the Easement Aareement conveylna the 10-foo1 perpetual public <br />pathway easement to the City, and authorize Mayor and Clerk <br />Adml n i strator to execute the easement agreements after' they <br />have been executed by the grantors named therein, Motion <br />carried unanimously. ' <br /> <br />B. Bonds <br />Lynden reviewed his letter of 6/26/75 re Pemtom PUD - Release <br />of Performance Bonds and Replacement with Maintenance Bonds. <br /> <br />In discussion of Open Space Bonds, Lynden reported he has <br />requested Pemtom to replace Summit Insurance Co. performance <br />bonds which were terminated as of May 28, 1975; replacement <br />bonds have not been received to date. <br /> <br />Wingert advised he Wi II meet with Pemtom and the Home Owners <br />Association on Wednesday morning to review landscaping <br />changes. It was noted that a tot lot, to be located In the <br />South area, 7th Addition by Pemtom Villages, has not been <br />constructed. <br /> <br />After discussion, Wingert also agceed to discuss Inspection of <br />the plans with Schutta and to report to Council. <br /> <br />. <br /> <br />C. Pemtom North, First Addition - Utilities <br />Lynde" noted that maintenance bond covering utility Improve- <br />ments In the North 1st Addition should be amended to show <br />the correct one-year guarantee period after approval and <br />acceptance of these Improvements by the City - utilities <br />have beeg Inspected and approved but wi II not be accepted <br />until after roads have been constructed and accepted. <br /> <br />Ordinance Repealing Ordinance 100 <br />Lynden read Ordinance No-. 189 In ITS entirety. <br /> <br />Crichton moved, seconded by Wingert that Council approve the adoption <br />of Ordinance No. 189, AN ORDINANCE REPEAllHG ORDINANCE NO. 100, <br />RELATING TO THE REGULATION AND LICENSING Of DRIVE-INN BUSINESSES, and <br />authorize the Mayor and Clerk Administrator to execute same on behalf <br />of the Village. Motion carried unanimously. <br /> <br />Ordinance re Off-road Use of Recreational Vehicles <br />Lynden referred Council to draft of ordinance re Off-road Use of <br />Recreational Vehicles and suggested that title be changed to read <br />"..Recreatlonal Motor Vehicles And Snowmob'..l.!!.!. ..," <br /> <br />Wingert moved, seconded by Crichton, that Council introduce by title <br /> <br />-2- <br />
