I Meeting <br />Page t\;O <br /> <br />June 9, 1975 <br /> <br />PUBLIC HEARING <br /> <br />Ordinance No. 188 - Amendment to Zonln9 Ordinance No. 99 Relatln9 <br />to Fast Food Restaurants. <br />Mayor Crepeau opened the Public Hearing at 8:10 p.m. <br /> <br />. <br /> <br />After determining there were no questions or comments from the <br />floor, Council reviewed the Ordinance. The Public Hearing was <br />closed at 8:30 p.m., after which Lynden read the Ordinance In Its <br />entirety, Incorporating the amendments noted. <br /> <br />Wingert moved, seconded by Feyerelsen, that Counc!1 adopt Ordinance <br />No. 188, AN ORDINANCE AMENDING ORDINANCE NO. 99, AS AMENDED, THE <br />ZONING ORDINANCE, BY CHANGING THE DEFINITION OF "DRIVE-INN BUSINESS", <br />ADDING DEFINITIONS OF "RESTAURANT" AND "FAST FOOD RESTAURANT", ADDING <br />"FAST FOOD RESTAURANT" AS A SPECIAL USE, AND SUBSTITUTING "CITY" <br />FOR "VILLAGE" WHEREVER THE SAME APPEARS, as read; authorizing Its <br />execution by the Mayor and Clerk Administrator on behalf of the <br />City of Arden Hi I Is. Motion carried unanimously. <br /> <br />Ordinance No. 100 <br />Counc! I discussed the provisions of Ordinance No. 100, after which <br />Crichton moved, seconded by Woodburn, that Councl I Introduce by title <br />AN ORDINANCE REPEALING ORDINANCE NO. 100. Motion carried (Crepeau, <br />Crichton, Woodburn and Wingert voting In favor of the motion; <br />Feyerelsen voting In opposition.) <br /> <br />Matter was referred to Lynden to prepare Ordinance for Council <br />consideration <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />Case No. 73-28, Hunters Park Fourth Addition. <br />Lynden referred Counci I to his letter of June 6, 1975 re approval <br />of Amended Final Plat of Hunter's Park Fourth Addition; and Park <br />Dedication Conveyances. Lynden recommended Council approval of <br />the Amended Final Plat, as submitted, on the basis of the provisions <br />noted in his letter. <br /> <br />Wingert moved, seconded by Crichton, that Council approve the Amended <br />Final Plat of Hunter's Park Fourth Addition; authorizing Its exe- <br />cution by the Mayor and Clerk Administrator. Motion earrled unanimously. <br /> <br />Case No. 74-36, C.G; Rein - Park Dedication <br />Matter was deferred to Council meeting of June 16, 1975. for title <br />opinion from Lynden. <br /> <br />Case No. 75-6. Arden Manor Amended Special Use Permit <br />Lynden referred Council to his letter of June 6, 1975, re Ownership <br />and Encumbrance Report for Twin Parks, inc. <br /> <br />Lynden reported that Van Putten has Indicated that partial release <br />of the liens can probably be obtained by Thursday, mortgagee Is <br />releasing funds for possible liens. Lynden also noted that the <br />Bond refers to the original Special Use Permit - rider should be <br />attached tying the bond to the Amended Special Use Permlt. <br /> <br />... After discussion, Crichton moved that Council not accept the <br />recreational park and access easements untl I developer can produce <br />written satisfaction of leins and Judgements and has obtained written <br />consent to conveyances from two mortgagees. Motion was seconded <br />by Wingert and carried unanimously. <br /> <br />Lift Station Easement, Sewer 12-13 - J. Bussard <br />Bussard suggested that Council average the first two appraisals <br />and not consider the third appraisal, In negotiating a settlement <br />for the 11ft station parcel to be conveyed to the Village. <br /> <br />In discussIon, Feyerelsen recommended that Council pay Bussard <br />$8,250 for ~he 11ft station property, based on the following: <br /> <br />$3,750 - third appraisal <br />3,000 - l$/month for rental of the property. <br />1,500 - special ass.ssments <br />$8,250 Total <br /> <br />';'2- <br />
