<br /> McNiesh was requested to write to Mr. Heimbach, informing him of the inadequacy
<br /> of the application documentation, and to advise of Council action.
<br /> After discussion of the fill which has been placed on the property, which was
<br /> 7 ~cribed as unsightly and an attractive nuisance, Wingert moved, seconded by
<br /> ~~(~, that Heimbach be instructed to remove the excess fill placed on the
<br /> , lots and that the surface be restored, in-so-~ossible, to its cO~ior
<br /> to filling. Motion did not carry (Wingert, voting in favor; ,
<br /> Feyereisen, Olmen voting in opposition).
<br /> . It was noted that the fill, consisting of concrete chunks, reinforcing wire and
<br /> cable (broken parts of streets) is hazardous for children in the neighborhood _
<br /> several children have been injured.
<br /> Crichton moved, seconded by Feyereisen, that this nuisance be referred to the
<br /> Rice Creek Watershed District, Village Engineer and Village Attorney for recom-
<br /> mendations re removal of this hazardous condition and aesthetic nuisance. Motion
<br /> carried (Feyereisen, Crepeau, Crichton, Olmen voting in favor of the motion;
<br /> Wingert voting in opposition).
<br /> Case No. 74-14, Townhouse Villages North, First Addition:
<br /> Preliminary Plat
<br /> Wingert referred the Council to the Preliminary Plat of First Addition,
<br /> Townhouse Villages North. and to the Minutes of the Planning CommiSSion
<br /> Meeting of October 1, 1974.
<br /> After review of the plat, Wingert moved, seconded by Crichton, that Council
<br /> approve the Preliminary Plat of Townhouse Villages North, First Addition,
<br /> subject to approval of Village Engineer. Motion carried unanimously.
<br /> It was noted that Development Agreement should provide for landscape inspection
<br /> by the Village; costs of inspection to be paid by Pemtom.
<br /> Park Dedication
<br /> Wingert referred the Council to the Appraisal for Pemtom, Inc. prepared by
<br /> F.M. and E. V. Dolan, Realtors and Appraisers, St. Paul, Minnesota, and to
<br /> Attorney Lynden's letter of October 10, 1974.
<br /> After discussion, Wingert ~ved, seconded by Feyereisen, that the Council
<br /> establish the land value at $4,100 per acre. Motion carried unanimously.
<br /> It was noted that Ordinance 175 provides that the developer shall dedicate
<br /> such portion of his development tract, not to exceed 15 percent thereof as
<br /> the Village Council deems to be reasonable and in the public interest.
<br /> Council referred this matter to the Village Attorney, Parks Director Buckley
<br /> and Mr. Hill to negotiate and present to Council for consideration at the
<br /> next Council meeting.
<br /> Case No. 74-31, Building Permit - Charles Schwab
<br /> Mr. Schwsb was present and described the proposed office building as architecturally
<br /> matching the existing building on the site; stating that the new building will be
<br /> . used for additional offices and warehouse.
<br /> Wingert referred the Council to the proposed site plan and to ~he Minutes of the
<br /> Planning Commission Meeting (Oct. I, 1974), and moved that the .Counc.f.l approve
<br /> issuance of the Building Permit for the office building, in accordance with plans
<br /> submitted, subject to approval of the drainage plans by the Village Engineer.
<br /> Motion carried unanimously.
<br /> Wingert moved that McNiesh request permission from the Highway Department for
<br /> Schwab-Vollhaber to plant and maintain plantings on Highway Department right-of-
<br /> way, in accordance with plan submitted. Motion was seconded by Crichton and
<br /> carried unanimously.
<br /> Case No. 71-9, Bethel ColleKe Academic Complex - Request for Release of Landscape
<br /> Bond
<br /> Wingert referred the Council to a memo from Building Inspector Larry Squires,
<br /> dated October 1, 1974, and moved that the Council direct Squires to release the
<br /> landscape bond, Motion was seconded by OImen and carried unanimously.
