7 <br />TW185\1\1011577.v13 <br />Maintenance of any and all temporary stormwater facilities shall be the <br />responsibility of the Developer. <br />U. All disturbed areas of boulevards shall be restored with sod. All areas of the <br />Project Site, where disturbed, shall be sodded or seeded and maintained. <br />The fee owner of the Subject Property shall mow and maintain all site <br />boulevards to the curb line of the public streets. <br />V. A violation of any condition set forth above shall be a violation of the <br />TCAAP Redevelopment Code (the” TRC”) and shall be cause for <br />revocation of the Project Approvals. <br />W. The approval of the permitted adjustments for the Subject Property shall not <br />be interpreted as an approval of any similar permitted adjustments for future <br />plat applications within the Thumb Parcel. <br />3. RIGHT TO PROCEED. <br />A. The Developer may not grade or otherwise disturb the earth on the Project Site until <br />all the following conditions have been satisfied: <br />1) This Agreement has been fully executed by both parties; <br />2) The Security has been received by the JDA, <br />3) The grading permit has been obtained by the Developer, and <br />4) To the extent that any grading will be outside of the Subject <br />Property, the Developer has obtained the Temporary Easement. <br />B. Within the Subject Property or the Thumb Parcel, the Developer may not construct <br />sewer lines, water lines, streets, utilities, public or private improvements, or any <br />buildings until all the following conditions have been satisfied:
